MEETINGS SET TO DISCUSS BRUNOT HUNTING AGREEMENT

The Colorado Division of Wildlife and the Southern Ute Indian Tribe have scheduled two more open house meetings to explain the Brunot hunting agreement: Oct. 21, 5-7 p.m., Holiday Inn, 1391 Townsend Ave., Montrose; Oct. 29, 5-7 p.m., Hunter Education Building, DOW headquarters, 6060 Broadway, Denver.

Officials from the DOW and the tribe will explain the Memorandum of Understanding recently signed by the tribe and the state of Colorado regarding hunting by tribal members in the Brunot Agreement area.  In 1874, Congress approved an agreement between the United States and certain Ute Indians in Colorado, known as the “Brunot Agreement”. Under this agreement, the Utes ceded land to the United States but reserved a right to hunt in that area for “so long as the game lasts and the Indians are at peace with the white people.”

The Brunot Agreement covers the land in an area which extends approximately, from U.S. Highway 160 on the south to the southern boundaries of Montrose and Gunnison counties on the north, from the middle of Mineral County on the east, and to just west of Cortez on the west.

A meeting was held Oct. 14 in Durango.

Coloseum Software Corporation has developed software that will help dealers
record all of the information that is unconstitutionally required by the
federal government — and to keep that information in a way that insulates
them from bogus prosecutions at the hands of the Bureau of Alcohol, Tobacco,
Firearms and Explosives (aka The Gang).

The document that is most often involved in “gotcha”
injustices is the Form
4473 which all customers must fill out when buying from a licensed federal
firearms dealer — a requirement that is yet another unconstitutional
imposition by the feds.

One of the favorite tricks of the BATFE has been to pounce on trivial
customer errors such as writing “Blto” instead of
“Baltimore” on the 4473
Form. One dealer supposedly showed his willfulness in breaking the law when
his clerks missed some sixty-plus instances when customers tried to
“sneak”
Blto past those eagle-eyed inspectors from The Gang.

While this does nothing to fight crime, it has allowed The Gang to reduce
the ranks of dealers by some 85 percent since the Clinton presidency.

The genius of Coloseum’s software is that it allows a dealer to walk a
customer through the Form 4473 without making a single mistake. With an
electronic signature, the computer’s form can be printed, providing a
perfect 4473 available for The Gang to inspect.

A foolproof way of filling out the 4473 would reduce the number of dealers
put out of business. That’s the advantage of using the Coloseum software.

So Coloseum approached the BATFE several months ago to discuss its plans to
release the first eForm 4473. The company wanted to make sure that it was
complying with all applicable federal laws and get the agency’s approval for
the product.

The BATFE wanted to see the details of the program, which left the directors
at Coloseum a bit hesitant, as companies are reticent to expose the details
of a product before it’s released to the market place.

No problem, Coloseum was told. The agency would protect the details of
their product.

Well, that was a lie.

The Gang assigned a liaison, Ms. Melinda Whitworth, to work with Coloseum.
She dealt with the company for several weeks, asking many detailed
questions. Again, Coloseum was led to believe that, if they worked with Ms.
Whitworth, they would get approval for their product.

Well, one of the Gang’s representatives called for a meeting with Coloseum
— a meeting which took place earlier this month. It was at that meeting
that Coloseum was told by an ATF agent that, “The BATF is in the
process of
creating our own technologies.”

Coloseum asked for clarification — did that mean that BATFE was developing
its own software, similar to Coloseum’s? “Yes” was the response.

James LaMonte, the CEO and founder of Coloseum Software Corp. was
dumbfounded. “As a small business owner, I never would have thought that
our biggest competition was the United States Government,” he told Gun
Owners of America.

After all, the IRS does not publish a “government version” of
Turbo Tax.
It’s private companies that produce such products for public use. The Gang,
as it is so apt to do, was once again trampling on the little guy.

Oh, and what about their “liaison,” Ms. Whitworth? At the
recent meeting,
Coloseum found that Ms. Whitworth — who was supposedly helping the company
get ATF approval of its software — was in charge of the team that is
developing the copycat software at ATF.

Ms. Whitworth even had the effrontery to apologize for not having developed
a product as good as Coloseum’s.

Here is the bottom line. If The Gang gets their software out to dealers
(probably for “free”) before Coloseum gets to market, then
the government’s
stolen version of the software is public domain. No one would ever need to
buy Coloseum’s intellectual property.

Coloseum is sending a free copy of its product to dealers so they can
install the software on their store computer. If dealers need additional
copies for a second or third computer, they can buy additional copies, as
well. Hopefully, dealers will pounce on this opportunity.

What Coloseum is doing is unprecedented. And so, it seems, is the blatant
thievery brazenly carried out by The Gang.

If dealers decide they just want to use the Bureau’s software, they should
first consider that they will be getting a much inferior product. Moreover,
The Gang’s software means that the government will have unrestricted access
to all of the dealer’s business records because it will allow
“back door”
access by the ATF. This kind of untrammeled access of all dealer records
would not be possible with Coloseum Software.

It is long overdue that President Bush clean house at the BATFE. He needs
to fire the Acting Director of the Bureau and command that employees destroy
their stolen property.

It should come as no surprise that the Brady Campaign and the American Hunters and Shooters Association (AHSA)–one, the leading anti-gun lobby in the country and the other, a phony front group whose mission is to confuse sportsmen–seem to have their response orchestrated. What both attacks lack, is a complete revelation on the real records of the two candidates. That is left out because the whole record proves that NRA-PVF chose the right man

With the election less than one month away, Gun Owners of America is
doing its best to keep gun owners informed about who is protecting your
rights in the Congress.

Many gun owners are familiar with the differences between the candidates
at the presidential level, but how well do they know the views and actions
of those who are running at the congressional level?

On the campaign trail, almost no candidates for Congress admit to being
against gun rights, making the tasks of compiling the Gun Owners of
America congressional candidate rating both more difficult, and more
important.

GOA determines grades for candidates first based on any past voting
record. Then, all candidates receive a detailed questionnaire. But what
about those with no record and who were not open enough to return a
questionnaire that would reveal their true colors?

In past elections such candidates could be assigned grades by simply
going to a campaign website. Learning what a candidate thought about
issues like banning “assault weapons” and waiting periods for
handgun
purchases was lurking behind a button labeled “gun control.”

Not any more. For one thing, it’s virtually impossible to find a link that
says “gun control” on any campaign website. If a candidate
mentions gun
rights at all (and most don’t) it is usually in the context of
“protecting
Second Amendment rights.”

A reader will find comments such as this one, referring to the recent
Supreme Court decision striking down the gun ban in the nation’s capital:

“I agree with the Supreme Court’s interpretation last week that an
absolute prohibition against gun ownership violates the Second
Amendment right for citizens to bear arms.”

That may sound good at first blush, but a careful reading will reveal
that this statement — made by a former mayor who had considered
joining other cities in suing gun makers out of existence in 1999 — is
almost meaningless.

Facing this kind of doublespeak, it is especially important that voters
take advantage of tools like the 2008 Gun Owners of America voter
guide.

The stakes are high in this election, as they always are. The main
focus is on the presidential race. If elected, Barak Obama would be the
most anti-gun president this country has ever seen, and his
vice-presidential candidate Joe Biden is just as bad. John McCain has
been all over the map on the gun issue, but he did choose a stellar
pro-gun running mate in Sarah Palin.

While the White House may be up for grabs, liberal Democrats are in
firm control of both chambers of Congress.  With all the media
attention on the race at the top of the ticket, it is important to
remember that it is in the Congress where most of the battles over
gun rights occur.

SAF SETTLES NEW ORLEANS LAWSUIT

BELLEVUE, WA – The Second Amendment Foundation has reached an agreement with the City of New Orleans in a 2005 federal lawsuit that stopped the city from seizing firearms in the wake of Hurricane Katrina.

The landmark lawsuit, a joint effort by SAF and the National Rifle Association, was filed in September 2005 after police and National Guardsmen began confiscating firearms without warrant or probable cause from citizens who were not suspected of committing any crimes. Under terms of the settlement, which now awaits a judge’s signature, the city must try to return all firearms that were seized. Gun owners will be notified by mail within 30 days of the court’s approval that they can retrieve their guns.

“While we are delighted that this case is now settled,” said SAF founder Alan Gottlieb, “it should never have been necessary. When a disaster strikes, no government entity or official should arbitrarily decide that citizens must be disarmed and left defenseless, and that is what happened in New Orleans. These gun seizures were conducted without legal authority, under color of law and often at gunpoint, and that must never be allowed to happen again anywhere on American soil.

“What happened in the days after Hurricane Katrina was an outrage,” he continued. “We hope this permanent injunction sends a signal to mayors and police chiefs everywhere that we live in a nation of laws, and those laws are not subject to their whims. You do not suspend Constitutional rights just because of a storm or earthquake or some other natural or man-made disaster.

“We are proud to have partnered with the NRA on this effort,” Gottlieb stated. “This is not simply a victory for SAF or NRA members in New Orleans, but for all American gun owners. Despite indifference and obstruction by the city, perseverance has prevailed.”

LIVING WITH WILDLIFE PROGRAM

Living with Wildlife Program to be held in Broomfield October 22nd

Have you ever wondered why coyotes live so close to people?  How prairie dogs play a part in the ecosystem?  Or what is the best way to get rid of the smell of skunk spray?   If so, join us for a presentation on urban wildlife, conflict avoidance and urban wildlife biology and learn more about Colorado’s wildlife neighbors.

If you visit or live near open space, this is a great opportunity to hear a presentation by Broomfield’s District Wildlife Manager, Claire Solohub.  The event is sponsored by the Broomfield Open Space Foundation, Division of Wildlife, and City and County of Broomfield.  The Broomfield Nature Program will also have volunteers on hand to provide information on educational programs.

Specific species discussion will focus on coyotes, foxes, raccoons, skunks and prairie dogs and will address issues such as:

-Coexisting with wildlife
-Keeping pets safe
-Keeping wildlife wild
-Techniques to minimize nuisance and damage situations
-Enhancing backyard habitat to encourage/discourage wildlife

Refreshments and Q & A to follow the presentation.
