On July 10, the U.S. House of Representatives voted to designate the
Washington-Rochambeau Trail, which stretches 600 miles from Rhode Island to
Yorktown, Virginia, as a National Historic Trail. Such a designation would
place the trail under the jurisdiction of the Department of Interior and the
National Park Service, thus subjecting the Washington-Rochambeau to the
current NPS gun ban.

Carrying firearms on land controlled by the NPS is prohibited, even if the
state in which the land is located allows firearms. The only way you can
legally have a firearm anywhere on National Park land currently is by having
it unloaded and inaccessible, such as locked up in your trunk.

While the Interior Department recently (after seven years of foot-dragging)
proposed new rules to partially reverse the gun ban, they have not yet taken
effect. If and when they do go into effect, most gun owners would still not
be allowed to possess firearms on these lands because, among other problems
with the rule, open carry would remain prohibited. Congress still needs to
take action to make the gun ban repeal complete and permanent.

Before the bill passed the House, Rep. Rob Bishop (R-UT) filed an amendment
with the Rules Committee to protect the Second Amendment on the trail. His
amendment would have required that state and local laws govern firearms
possession and carrying on the trail. The Rules Committee changed that
language and made it apply only to hunting.

Rep. Bishop denounced the Committee during debate on the measure, pointing
out that the committee “did not defend all of the Second
Amendment, only the
so-called hunting rights, which is not, not the purpose of the Second
Amendment.”

Rep. Bishop made a motion to send the bill back to committee with
instructions to restore the pro-gun language. His motion narrowly failed,
211-202.

The bill (H.R. 1286) now heads to the Senate where the situation is much
more complex. Dr. Tom Coburn (R-OK) has been a leader on repealing the NPS
gun ban. Sen. Coburn previously introduced a bill (S. 2619) to rescind the
ban, but it remains bottled up by senate leadership. Earlier this year,
Sen. Coburn entered into a so-called unanimous consent agreement with Senate
Majority Leader Harry Reid to get a vote on his repeal language, but Sen.
Reid reneged on his promise and blocked the vote.

Sen. Coburn remains committed to forcing a vote on killing the NPS gun ban,
and Sen. Reid seems equally committed to blocking that vote. Reid’s most
recent maneuver to silence Coburn is to introduce (as one measure) a package
of bills that Coburn has held up on constitutional grounds. Rolling many
bills into one, loaded with pork and pet projects to dole out to a variety
of senators, is a transparent attempt to erode the widespread support Sen.
Coburn has among his colleagues.

If Reid is successful in passing so many bills at one time without debate,
the ability of individual senators to force deliberate consideration and
roll call votes on important legislation will be threatened.

The reason each state has two senators is stop large population centers
(such as an unholy alliance of NYC, Chicago and Los Angeles) from dictating
their will upon the rest of the country. Historically, the rules of the
Senate have always allowed any individual senator to keep the full body from
acting in an unconstitutional manner.

If other senators allow Reid to act as the dictator of the senate, Coburn’s
ability to stop the expansion of the NPS gun ban will be severely
threatened.

Unless Sen. Coburn’s effort is successful in repealing the gun ban, the 600
mile Washington-Rochambeau — which encompasses parts of major thoroughfares
such as I-95 — will become yet another Second Amendment infringement zone
effecting hundreds of thousands of gun owners up and down the East Coast.

Olofson Relief Fund

David Olofson has been subjected to a gross miscarriage of justice.
What happened to Olofson could happen to any American who owns a
semi-automatic firearm.

He was convicted of knowingly transferring an unregistered machine gun
— a standard semi-auto rifle which fired two three-round bursts and
then jammed. Gun owners call that a malfunction. The federal government
calls it an easy way to get a felony conviction. Olofson was sentenced
to 30 months in federal prison.

David Olofson is an information technology professional with a wife,
three children and a mortgage. Until his conviction, he was also in the
National Guard.

help the Olfoson’s make their mortgage and (their one) car payments
while Dave is unable to work.

The Bakken Formation and energy independence

The Bakken Formation like the Pieance Basin Oil Shale holds great promise for development. Price and technology have been the big considerations in the past when exploitation of these resource’s have been discussed. Now, it seems that the price of oil is such that cost effectiveness may well be past the point of profitability. The opportunity costs involved take on many faces though. Mostly hunters and fishermen, but also ranchers, farmers, and those that care for the environment.

My Fiance who is a Geological Engineer and Geo-chemist has told me that the technology is now available that would allow extraction with minimal environmental impact. That, however does not include the refinery, or some portions of necessary pipelines. Those two issues are pretty troublesome to someone like me.

Then we get to the big money rumor mills that say there are impending finds in the north of Russia and in Indonesia. If true, the American Dollar will be in some rather serious trouble. Those folks in other places that are in fact propping up America through purchasing T-Bonds and such will in all probability stop doing so. Making a switch to alternative energy sources will be expensive enough without having to deal with a near worthless currency. This is where International and Political Economics come into play with a vengeance.

The flip side is that if we can rapidly build alternative energy sources as well as use the oil that we have available we should be able to weather the storm, so to speak. We also need to have a President that has the inner courage to reverse President Nixion’s policy that took the United States off the gold standard.

I believe that we are indeed heading into a rather rough row to hoe.

Best State Agency

Granted, this is only my opinion, but I think that over all the best state agency in Colorado is the Division of Wildlife. True, they have their problems from time to time, but compared to other agencies that I have had contact with? The DOW wins hands down.

The new course that is offered on Mountain Lions, sorry; I absolutely hate the chosen name “Puma” and will continue to call them Cougars or mountain Lions is the only one of it’s kind that I am aware of. There are also many educational opportunities for children and women. program is by far the most important one. (Available through the link above.) During my career I saw roughly twelve hunting / shooting sports “accidents.” Perhaps it is my background in Emergency Medical Services that influences me, but I truly believe that the Hunter Safety Course is by far the most important program offered. Said “accidents” just do not happen if the things taught in Hunter Safety, or the National Rifle Associations basic safety course are followed.

From day one this project has been one big boondoggle. Jon Caldara of The Independence Institute has led the charge against this monstrosity that will certainly bankrupt the cities and citizens of metroploitian Denver.

From issues of heavy handed emmenient domain to what I am now believeing were pre-planned statements that were less than truthful this entire project is beggining to have the appearance, if not the smell of outright corruption.

American Gestapo?

Barack Obama showed more of his true intentions the other day. Just who will this new force answer too? An American Gestapo is a sure way to a path of revolution here in these not so United States. Others have called me crazy in the past when I reffered to “Authoritarians.”

“According to Obama, the U.S. “cannot continue to rely on our military in order to achieve the national security objectives we’ve set.” He continued, “We’ve got to have a civilian national security force that’s just as powerful, just as strong, just as well-funded.” Whoa there, compadre! (That’s a little Spanish there for the man who wants us all to learn it.) Will this “national security force” also wear brown shirts? Oddly enough, it seems that Obama’s campaign realized that wouldn’t fly—the line was stricken from the transcripts given to the media, though it is still in the video posted on YouTube.”

For those of you that watched “Black in America” on CNN, you might be interested in how it is to be White in America

1. We are racists. WE can not use the “I have a black friend” excuse, it doesn’t work. WE have either owned a black person or OUR family has, and therefore WE as white people OWE every Black person in America something.

2. WE are in control of ALL money in America, WE have the ability to hire anyone, and WE never hire black people because they are black. That is the rule.

3. When Black folks walk past US and WE grab your wallet or purse, that is a racist response no matter where WE are or what time of day it is. IT is acceptable however to open OUR wallet or purse and empty the contents on the sidewalk and run because (see #1 WE OWE THEM).

4. WE vote for Barak Hussein Obama because you owe black people.

5. WE don’t vote for Barak Hussein Obama because you are racist.

Oh and according to all politicians, movie makers, media outlets, sitcoms, radio hosts, bloggers or basically ANYONE saying anything… White, hetero sexual, Christian, Males are the reason for everything bad in America. However; if you mention any facts that do not agree with that assertion YOU ARE A RACIST!

I hope one day to see true racial equality, I hope one day to see the end of the victim mentality in America, and the start of the personal responsibility era, maybe my grandchildren will see it but I honestly believe it is ingrained in the culture now. Oh Shit I must now be a racist.

D.C. Refining of Gun Laws–Offensively Stupid

Washington D.C. is not into following the law it would appear. At least when it doesn’t suit them is probably a more accurate way to phrase the situation.

Only a few weeks after the U.S. Supreme Court’s ruling in the Heller case, which struck down D.C.’s ban on handguns and allowed having a firearm in operable condition at home, D.C. has passed “emergency” law and new police regulations intended to retain as much of the ban and storage requirement as possible. The law was crafted in consultation with the Brady Campaign, according to the Washington Post.

There are many objectionable features to the new D.C. law and regulations, but two stand out as particularly egregious. Though the Supreme Court ruled that D.C. could not ban handguns, the new rules would still ban all or most semi-automatic pistols. And in spite of the fact that the court ruled that D.C. cannot ban the use of guns for protection in the home, the District still prohibits having a gun loaded and ready unless an attack within your home is imminent or underway.

Without Congress’ intervention, D.C. can violate the intent of the Heller decision indefinitely. That is because under “Home Rule,” D.C.’s emergency bills are not subject to review by Congress, and D.C. can reinstitute “emergency” laws every 90 days. The city’s officials are already thumbing their noses at the Supreme Court.

Personally, I would love it if the Supreme Court charged all those involved in these shenanigans with contempt and had them paraded before the Court dressed in those pretty orange jump suits, on television, and had some serious discussions with them.

Denver, and the DNC a Target rich Environment

I was speaking with a few former coworkers the other day about the upcoming convention. It appears that yes indeed, there is trouble on the horizon. Paramedics and Firefighters will be targeted just like the police will be by several anarchist groups. Before long I was asked about defensive measures that they could take.

I will not go into specifics here about those moves. Why tip off opponents as to how you are preparing? Operational security is just as important here on what very well prove to be some very mean streets as it is in military planning.

After a bit one guy asked why I thought that the place could become a hell hole in a hand-basket. It really is a simple explanation.

  • The DNC will have concentrated various disparate groups that all have opponents that are willing to use violence as a means of forcing their will upon all of the rest of us.
  • Professional hell raisers are already saying that they will cause civil unrest.
  • Mayor Hickenlooper is a negotiating wimp. He would rather try and talk his way out of a wet paper bag than use a knife to free himself.

So, we will, or very well might have groups that hate major components of the Democrat Party. There are Muslim extremist among us that operate in a state of misogyny. There are Christian extremist that would rather set off a bomb among the homosexuals than pray for them. There are racist groups that will not stand for the possibility of a black President. Then there are groups like recreate68, that just want death and destruction, along with fifteen minutes of fame. There are far right extremist’s that will have Wayne Pachelle and many other people that are on their “ten most wanted ” list.

Now they have moved the final ceremonies to Mile High Stadium at Invesco Field … The place is ; A Snipers dream. A Morter mans dream. A Chemical Weapons fighters dream, and, the list goes on.

Folks, I happen to really like folks from Akansas. But even in the best kettle of Cod, there are a few that stink up the barrel.

ARKANSAS MEN GUILTY IN COLORADO POACHING INCIDENT

The Colorado Division of Wildlife (DOW) has wrapped up the poaching case against six Arkansas men with the final two suspects entering guilty pleas in Moffat County District Court.

In late 2005 Colorado Wildlife Officer Mike Bauman began hearing stories about a group of Arkansas hunters who were poaching in the Bible Back Mountain area south of the Colorado-Wyoming border. During the 2006 hunting seasons Bauman was able to determine that a group of men from Arkansas were, at a minimum, buying leftover licenses for Game Management Units 4 and 12 but most likely hunting in Game Management Unit 5.

In 2007, wildlife officers set up a hunting camp in the area and posed as hunters to gather evidence against the group. Officers were able to document two deer that were killed without proper licenses, trespassing on private land, wounding of deer without following up on shots as required by law, and the illegal killing and willful destruction of one buck deer by two members of the hunting party.

“It was blatant poaching. At one point, individuals in the Arkansas camp were seen shooting and killing a deer then tying the head to a tree so they could later return and claim the antlers,” Bauman explained. “The incident occurred on private land the men had no permission to enter and in a unit for which they didn’t have a license.”

It was determined that the hunters were staying across the Wyoming border and Colorado officers contacted investigators with Wyoming Game and Fish to request assistance with monitoring the group at and around their Wyoming motel.

As the Arkansas hunters were packing up and preparing to leave for home, Colorado wildlife officers caught up with part of the group to interview them and charge the suspects. Additional members of the group were detained by Wyoming officers who also collected evidence from the hotel and from a Wyoming meat processor. Based on interviews with the group, wildlife officers determined that, in addition to the 2007 violations, at least three deer were illegally killed in 2006. Assistance was requested from wildlife officers in Arkansas who collected evidence from the men’s homes.

“We appreciate the cooperation we received in this case from Wyoming Game and Fish and Arkansas Game and Fish,” added Bauman. “While we had some of the charges locally, the evidence that was obtained from previous years and from the hotel made it possible to show an ongoing pattern of poaching violations.”

Based on the investigation the following individuals were charged:

William Newton (DOB 06/06/1983), Hampton, Arkansas
Plead guilty to following charges as part of plea agreement:
1 count – Illegal take of three or more big game animals
2 counts – Waste of edible game wildlife
1 count – Illegal possession of a deer
4 counts – Hunting without a license
Sentencing: 30 days in jail, $9,500 fine plus court costs, forfeiture of rifle and illegally taken wildlife.

Bradley Shankles (DOB 06/21/1983), Hampton, Arkansas
Plead guilty to following charges as part of plea agreement:
1 count – Felony willful destruction of wildlife
2 counts – Hunting without a license
2 counts – Illegal possession of a deer
1 count – Waste of edible game wildlife
1 count – Defacing a firearm
Sentencing: Deferred sentence on felony willful destruction charge, fine of $5,000, four year ban from hunting in the United States, four years of supervised probation, $2,000 donation to Operation Game Thief, forfeiture of rifle and illegally taken wildlife.

Richard W. Carson (DOB 03/14/1964), Hampton, Arkansas
Plead guilty by payment of citation
1 count – Failure to pursue wounded wildlife
1 count – Hunting deer without a license
1 count – Illegal possession of a deer
1 count – Unlawful trespass on private property
Warning – hunting without orange clothing
Carson chose not to contest the charges and instead plead guilty by paying $2,041 in fines. He was assessed 65 points against his hunting privileges.

Michael B. Welch (DOB 07/18/1983), Bearden, Arkansas
Plead guilty by payment of citation
1 count – Hunting deer without a license
1 count – Illegal possession of a deer
Warning – Failure to tag
Welch chose not to contest the charges and instead plead guilty by paying $1,781 in fines. He was assessed 30 points against his hunting privileges.

Anthony Moser (DOB 05/02/1987), Hampton, Arkansas
Plead guilty by payment of citation
1 count – Hunting deer without a license
1 count – Illegal possession of a deer
Moser chose not to contest the charges and instead plead guilty by paying $1,781 in fines. He was assessed 30 points against his hunting privileges.

Harlan C. Welch (DOB 01/12/1976), Hampton, Arkansas
Plead guilty by payment of citation
1 count – Uncased rifle on an ATV
Warning – Unlawful trespass on private property
Welch chose not to contest the charges and instead plead guilty by paying a $68 fine. He was assessed 5 points against his hunting privileges.

Five of the six men still face an administrative hearing process that will be conducted by the Colorado Wildlife Commission. Anyone assessed more than 20 points against hunting and fishing privileges is subject to wildlife hunting suspension hearings. The men could lose their hunting and fishing privileges in Colorado and 27 other states that are members of the Wildlife Violator Compact. Hearing dates have not yet been set for the men.

“Colorado has the largest migratory mule deer and elk herds in the nation,” concluded Ron Velarde, Northwest Regional Manager for CDOW. “Because of that spectacular resource we attract hunters from around the world. We welcome those who come here to experience what our great state offers, but we absolutely will do everything possible to catch those who believe that our remote areas provide enough cover to cheat and steal from Colorado’s citizens and true sportsmen.”

The Fourth of July, economics 101 revisited

LAND OF THE FREE

It is the Fourth of July. Should we hang out the red, white, and blue bunting from our office balcony…or the black crepe? Should we whine about the America we have lost, or give a whoop for what we have left of it?

That star-spangled banner still waves, but does it still fly over the land of the free, we ask? Or over a country with a spy camera on every street corner…a nation so deeply in debt that freedom has become a luxury it can no longer afford?

Whatever direction we take, we trip over a contradiction. Things always seem to be black and white at the same time.

That is why we took up tango, dear reader. People who dance the tango or write poems don’t let contradictions bother them. They glide across the floor and enjoy themselves. As far as we know, no serious tango dancer has ever committed suicide. It’s the mathematicians and engineers who blow their brains out.

An ideologue or a mathematician cannot tolerate contradiction. His little world has to fit together neatly, like a crossword puzzle. It is ‘cat’ in one direction and ‘day’ in the other. Each intersection has to work perfectly.

But that is not the way real life or real people work. A healthy woman loves her husband, but often hates him too. She has two eyes, and sees a slightly different view of him with each of them. What is wrong with that? Likewise, even a man with only a single eye cannot help but notice that the world is menaced by inflation and deflation at the same time…and that America is both free and un-free at exactly the same moment.

What we have come to dislike about the neo-conservatives is not that their view of the world is right or wrong – for how could we know? – but that it is so small. They are true believers in a very tiny world…one with no room for mystery, contradiction, ignorance or humility. It has to be small; otherwise they could not understand it.

Neo-cons think they can see what no mortal has ever seen: the future. That is the twisted genius of the ‘Preemptive Attack’; they stop the criminal before he has committed his crime!

They think they can know what no mortal has ever known: not only what is good for himself and his country…but what is good for the entire world. And they intend to give it to them, whether they want it or not. In today’s email box, for example, George W. Bush himself sends us the following message:

“…liberty is God’s gift to humanity, the birthright of every individual. The American creed remains powerful today because it represents the universal hope of all mankind.”

Here we will take a wild guess: there are probably more than a few bipeds hobbling around the planet for whom the “American creed” is not so much a hope as a dread.

But the president continues:

“We are winning the war against enemies of freedom, yet more work remains. We will prevail in this noble mission. Liberty has the power to turn hatred into hope.”

“America is a force for good in the world,” continues the leader of the world’s only super-duper power, “and the compassionate spirit of America remains a living faith. Drawing on the courage of our Founding Fathers and the resolve of our citizens, we willingly embrace the challenges before us.”

America’s citizens, meanwhile, are deeply in debt. They see little choice but to back the system, such as it is. Free or un-free, they could care less. Just keep the money flowing. They have come to rely on government. They need Fannie Mae…and unemployment insurance…and social security…and jobs…and the Fed…and fiscal stimulus. Or, at least, they think they do.

After 50 years of the Dollar Standard boom, the average American finds himself less free than ever. He is a slave to the highest government spending and biggest public debt burden in history…and to the heaviest mortgage and other private debt load ever. He has mortgaged up his house…he has taken the bait of credit-card lenders. Now he has no freedom left; he must keep a job…he must pay attention to the Fed’s rates…he must have an interest in George Bush’s government (for now he depends on it)!

“July 4 should be about celebrating freedom and independence,” wrote Richard Benson, published in this week’s Barron’s, “yet the bankers are the only people jumping for joy. Never have Americans owed so much in terms of their total debt, the ratio of total debt to income and the amount of cash flow the debt needs to serve it. Americans used to believe that if they were debt-free, they were free. Today, Americans just want the freedom to borrow more, even if it means they are on the way to becoming enslaved by their debt.”

The average citizen is only a few paychecks from getting put out of his house. He no longer has the freedom to step back…to reflect…to think…to wonder about things…or enjoy the contradictions. Instead, he must listen to the words of economists as if they meant something…and bow before the politicians who control his livelihood…and place himself at the beck and call of every government agency with a dollar to spend.

The message from George W. Bush concludes with an endearing personal note, in which “Laura joins me in sending our best wishes for a safe and joyous Independence Day…”

Laura who, we wondered? Oh yes…the First Lady.

How we got to be on a first-name basis with the woman, we don’t know. We have never even met her. Why she should wish us a happy day, we don’t understand. But these are the peculiar, baroque eccentricities of America that make it such an endearing place to its citizens and such a rich treasure for contemporary ethnologists and stand-up comics.

They, too, will wonder about the contradictions. Why do Americans celebrate “freedom” ever more loudly, while becoming ever less free…? How can they crow about the “home of the brave” when they attack pitiful, third world nations that can’t defend themselves? How can they ballyhoo their own independence when their armies occupy two foreign nations?

Most people will ignore the contradictions altogether. Many will see them as hypocrisy. Some will be outraged. And a few will hear the off-tempo tango beat, and enjoy the holiday anyway.
