Briefs Filed in D.C. Gun Ban Case

As the date for Supreme Court argument in District of Columbia v. Heller approaches, the filing of briefs has begun.  The District filed its brief last week.  In addition, various “amicus curiae” (friend of the court) briefs were filed with the court.

Hoping Something Will Stick To The Wall: Gun Ban Groups’ Briefs 
Nearly two dozen briefs have been filed with the U.S. Supreme Court by individuals and groups supporting D.C.’s bans on handguns, having a gun assembled within the home, and carrying a gun within the home. 

Outrage of the Week:  Are You A Bigot? This week’s Outrage comes from the Anti-Defamation League (ADL), which filed a friend of the court brief in the District of Columbia v. Heller case in support of keeping Washington, D.C.’s draconian gun ban on the books.  According to a recent ADL release (http://www.adl.org/PresRele/SupremeCourt_33/5207_33.htm), “The League urged the Court to ensure that states retain the ability to keep guns out of the hands of ‘violent bigots.'”   

Leading Democratic Candidates Call for Severe Restrictions on our Second Amendment Rights:  With the Presidential nominating season in full swing, trying to pin down the various candidates’ unequivocal stance on issues of import can often be difficult, if not impossible.  Amidst their political posturing and refining of positions at the recent Las Vegas Caucus, Senator Hillary Clinton (D-NY), Senator Barack Obama (D-IL), and former Senator John Edwards (D-NC), were asked a series of questions about the gun issue.  All called for severe restrictions on our Second Amendment rights.

California’s very conservative (and pro-gun) 4th Congressional
District has just turned into an “open” seat with the retirement of
Congressman John Doolittle. Conservative former state legislator Rico
Oller has thrown his hat into the ring, making this race GOA’s Number
One target for a house seat in the entire country.

A couple of points about this race. The registration numbers show 48%
of the district as Republican and 30% as Democrat — so whoever wins
the Republican primary clearly is the next Congressman. Especially
since the Democrat is an ultra-liberal card-carrying (really!) member
of the ACLU.

Next point. That California primary is mere months away, so
everything we can do for Rico Oller needs to be done NOW. That’s why
GOA is asking every member of our team to use the web to send Rico
Oller your most generous on-line campaign contribution as soon as
possible. If you can send additional donations during the few months
ahead, we urge you to do so.

Point three. Rico has a primary opponent in former liberal Republican
Congressman Doug Ose. During Ose’s six years in Congress, he earned a
GOA “F” on every single one of our ratings for house members.

Ose voted IN FAVOR of keeping the Washington D.C. gun ban. He voted
to outlaw individual sales at gun shows. He voted for mandatory sale
of trigger locks for any handgun sold. He voted to silence outside
groups like GOA at election time.

Doug Ose probably has his picture framed and hanging on the wall at
Handgun Control Inc. (now the Brady Campaign to Prevent Gun
Violence), since he was one of their best friends in Congress.

In contrast — Rico Oller was a perfect “A” rated member of the
California Legislature during his tenure. And, Rico is the human
equivalent of the “energizer bunny.” This guy is a type A++
personality, who never stops campaigning and promoting our Second
Amendment rights. Every time Gun Owners has an event in California,
Rico Oller is there, promoting our organization and the Second
Amendment. And he will be there for gun owners all over the country
when he is elected to Congress.

He missed something here

“The spin masters may think illegal immigration is an issue that pits conservative Republicans against liberal Democrats. But it doesn’t always. Nowadays, worry about illegal immigration is just as likely to mean that African Americans are terrified of racist alien gangs in Los Angeles. Asian Americans are frustrated that their relatives with college degrees wait years to emigrate legally, while thousands without high-school diplomas to the south simply break the law to enter the United States. And many Mexican Americans are probably tired of being expected to defend the indefensible of foreign nationals breaking immigration laws simply because they may share an ethnic heritage with illegal aliens. To the extent Democratic candidates ignore illegal immigration, or demonize those who worry over hundreds of thousands of new illegal aliens each year, or talk of guest workers and amnesty before they mention closing the borders, it is a losing issue that could alienate millions of voters. Democratic candidates can’t really claim that redneck racists are rushing to the border to clash with poor campesinos just crossing to better their lives, because many poor Democrats also resent how illegal labor drives down their own wages. It is mostly the American poor and middle class who worry about the sudden influx of thousands who don’t speak English and often need public assistance.” —Victor Davis Hanson

Mister Hanson missed something here, which is unusual to say the least. Americans are so fed up with the problems associated with illegal immigration that many are ready to take up arms to remedy themselves from the problem. Indeed, it is not vigilantism when the government refuses to take effective and proper action. It is rather the duty of citizens to rectify the situation.

Good Morning General

just couldn’t seem to get to work
on time. Every day, he was 5, 10, 15 minutes late.

But he was a good worker and really sharp, so his boss was in a quandary about how to deal with it. Finally,
one day, his boss called him into the office for a talk.

“Tom, I must tell you, I truly like your work ethic, you do a bang-up job, but being late for work nearly
every day is quite annoying to me as well as your fellow workers.”

Tom replied, “Yes, sir, I know. I’m sorry, but I am working on It.”

“That’s what I like to hear,” his boss said. “However, the fact that you consistently come to work late does
puzzle me, because I understand that you retired from the United States Air Force, and they have some pretty rigid
rules about tardiness. Isn’t that correct?”

“Yes. I did retire from the Air Force, and I’m mighty proud of it!” said Tom.

“Well, what did they say when you came in late?” asked his boss.

“They said, ‘Good morning, General’.” 

D.C. Court of Appeals Blocks Reckless Lawsuit

D.C. Court of Appeals Blocks Reckless Lawsuit On January 10, the District Columbia Court of Appeals found that the “Protection of Lawful Commerce in Arms Act” (PLCAA) blocked lawsuits under D.C.’s “Strict Liability Act.”  

D.C. Files Brief in Heller Case:  On January 4, the District of Columbia filed its brief in District of Columbia v. Heller, now before the U.S. Supreme Court. The District is appealing the U.S. Court of Appeals for the District of Columbia Circuit’s ruling that found D.C.’s bans on handguns, on having any gun assembled for use within the home, and on carrying a firearm within the home without a permit, violate the Second Amendment. 

NRA-ILA Investigating Citigroup Issues:  In late December, 2007, a large and well-known firearms dealer was informed by a company called First Data — which operates as Citi Merchant Services under license from Citigroup, Inc. — that it would no longer handle the dealer’s credit card processing business.   

California Appeals Court Strikes Down San Francisco Handgun Ban!  On January 9, the California Court of Appeals agreed with a lower court ruling that struck down San Francisco’s handgun ban as a violation of California’s state preemption law.  The ruling was in response to an NRA-led challenge to the ban.   

Outrage of the Week:  This week’s outrage comes courtesy of columnist Bernd Debusmann of Reuters News Service, and an article he recently penned.  This story, masquerading as a legitimate news article, might as well be an anti-gun organization’s press release.   

The battle for liberty is alive, and well.

VOLUNTEER OPPORTUNITIES IN PUEBLO

Volunteers are needed to assist the Colorado Division of Wildlife (DOW) manage Colorado’s wildlife and perform a variety of duties that benefit wildlife.
 
The DOW will host a new volunteer orientation January 19 from 10 a.m. until noon in the auditorium at Lake Pueblo State Park.
 
This two-hour session will cover different volunteer opportunities throughout the year where people can get involved in local wildlife projects. 
 
DOW volunteers assist in a variety of ways.  A sample of the kinds of projects include: Eagle Day Feb. 2; wildlife transport (training is 2/16); hatchery tours (training in March); walleye spawn (3/15); ongoing projects at the Bosque del Oso and Pueblo State Wildlife Areas; and bluebird and osprey habitat improvement projects (March training). 
 
The orientation will highlight different volunteer opportunities available for 2007 and will give registered volunteers the chance to sign up for future projects.  For more information, contact Jena Sanchez at (719) 227-5204. 
 
The Colorado Division of Wildlife is the state agency responsible for managing wildlife and wildlife habitat, as well as providing wildlife related recreation and maintaining a balance between human activities and wildlife.  Funding for the Division of Wildlife comes from the sale of hunting and fishing licenses and the habitat fees collected in conjunction with those sales.  The Division does not receive tax dollars from the Colorado general fund.

COLORADO RESIDENTS URGED NOT TO FEED DEER

muledeerbuck2.jpgThe Colorado Division of Wildlife urges state residents and visitors not to feed deer that are hanging around their yards or property.
 
“Deer require a very specific diet,” explained Don Masden, a biologist for the Colorado Division of Wildlife. “If they eat the wrong food they’ll just die with a full stomach.”
 
Deer digest very slowly and if they eat the wrong types of food and too much food they will not be able to digest or pass the material and they will die. So, deer should not be fed hay, pet food, fruits, vegetables or any type of table scraps.
 
If you have sage brush or other shrubs on your property, knock the snow off of those to expose some natural food for the animals.
 
“Feeding deer the wrong food will cause more harm than good,” Masden said.
 
Deer are most affected by the severe winter conditions that western Colorado is experiencing this year. But no food should be provided to any big game, officials emphasized.
 
Elk and bighorn sheep are better adapted to survive severe winters. Elk can eat a wider variety of material and because of their size can push and dig through deep snow to find food. Bighorn sheep live in steep areas that don’t hold snow, so they are not as affected by the snow depth.
 
The DOW will be conducting a winter feeding operation aimed at deer in the Gunnison Basin. A feed developed specifically for deer that has been formulated by DOW scientists will be used.
 
The DOW office will attempt to make some of that feed available to property owners. However, feed will not be delivered to the Gunnison office until sometime next week. Residents are asked to wait until mid-week to inquire about available feed. 
 
So far deer in the Gunnison Basin are in pretty good shape given the weather conditions. But based on past experience, wildlife managers know that the weather could soon start to take its toll on deer.
 
The DOW is looking for volunteers to help with the feeding effort. Those who can volunteer for several days should call Jennifer Kleffner, southwest volunteer coordinator, at (970)375-6704.

Funny that one position that is, or could be held by men was not even mentioned. If a woman can elect to have an abortion or not to. Then why can’t a man demand an abortion, or not be held responsible for child support if she refuses it? I personally know of at least a dozen men that were seduced as it were into eighteen plus years of paying for a womans life of leisure.

Lessons to be learned? Keep it in your pants men.

The Real McCain Record
Obstacles in the way of conservative support.

There’s a reason some of John McCain’s conservative supporters avoid discussing his record. They want to talk about his personal story, his position on the surge, his supposed electability. But whenever the rest of his career comes up, the knee-jerk reply is to characterize the inquiries as attacks.

The McCain domestic record is a disaster. To say he fought spending, most particularly earmarks, is to nibble around the edges and miss the heart of the matter. For starters, consider:

McCain-Feingold — the most brazen frontal assault on political speech since Buckley v. Valeo.

McCain-Kennedy — the most far-reaching amnesty program in American history.

McCain-Lieberman — the most onerous and intrusive attack on American industry — through reporting, regulating, and taxing authority of greenhouse gases — in American history.

McCain-Kennedy-Edwards — the biggest boon to the trial bar since the tobacco settlement, under the rubric of a patients’ bill of rights.

McCain-Reimportantion of Drugs — a significant blow to pharmaceutical research and development, not to mention consumer safety (hey Rudy, pay attention, see link).

And McCain’s stated opposition to the Bush 2001 and 2003 tax cuts was largely based on socialist, class-warfare rhetoric — tax cuts for the rich, not for the middle class. The public record is full of these statements. Today, he recalls only his insistence on accompanying spending cuts.

As chairman of the Senate Committee on Commerce, Science and Transportation, McCain was consistently hostile to American enterprise, from media and pharmaceutical companies to technology and energy companies.

McCain also led the Gang of 14, which prevented the Republican leadership in the Senate from mounting a rule change that would have ended the systematic use (actual and threatened) of the filibuster to prevent majority approval of judicial nominees.

And then there’s the McCain defense record.

His supporters point to essentially one policy strength, McCain’s early support for a surge and counterinsurgency. It has now evolved into McCain taking credit for forcing the president to adopt General David Petreaus’s strategy. Where’s the evidence to support such a claim?

Moreover, Iraq is an important battle in our war against the Islamo-fascist threat. But the war is a global war, and it most certainly includes the continental United States, which, after all, was struck on 9/11. How does McCain fare in that regard?

McCain-ACLU — the unprecedented granting of due-process rights to unlawful enemy combatants (terrorists).

McCain has repeatedly called for the immediate closing of Guantanamo Bay and the introduction of al-Qaeda terrorists into our own prisons — despite the legal rights they would immediately gain and the burdens of managing such a dangerous population.

While McCain proudly and repeatedly points to his battles with Secretary of Defense Donald Rumsfeld, who had to rebuild the U.S. military and fight a complex war, where was McCain in the lead-up to the war — when the military was being dangerously downsized by the Clinton administration and McCain’s friend, former Secretary of Defense Bill Cohen? Where was McCain when the CIA was in desperate need of attention? Also, McCain was apparently in the dark about al-Qaeda like most of Washington, despite a decade of warnings.

My fingers are crossed that at the next debate, either Fred Thompson or Mitt Romney will find a way to address McCain’s record. (Mike Huckabee won’t, as he is apparently in the tank for him.)
