Colorado: House Considering “Deny-On-Arrest” Legislation

The Colorado House of Representatives is currently considering legislation that would that would solidify an unconstitutional provision in the state’s background check system.

House Bill 1391, sponsored by State Representative Joe Rice (D-38), would extend a provision in state law that was due to sunset in July 2010.  The provision the bill extends would deny gun purchases to those with an arrest on their record, even if they were never convicted.  This deny-on-arrest provision would remove a constitutional right to own a firearm based on an arrest (an accusation), NOT a conviction.  It directly conflicts with the fundamental American doctrine of “innocent until proven guilty.”

Because the disposition of an arrest record isn’t always available, the burden of proof falls on gun buyers to prove they are eligible to purchase a firearm. In many cases, this costs these individuals thousands of dollars of their own money to prove their innocense.

The bill has been scheduled for a hearing on Monday, April 12, in the House Judiciary Committee.  Please call members of the committee and respectfully urge them to vote against HB 1391 and this unconstitutional attack on the Second Amendment rights of Colorado citizens. It has been said that California leads the way when it comes to social change. Usually for the worse… I would however submit that as distorted and stupidly off course as my home state  most often is? New York is just as much a leader in the destruction of freedom and Liberty. I mean think about it? This is a State that continually elects people like the straw purchase felon Michael Bloomberg, and the overtly treasonous to his oath to uphold the Constitution Charles Schumer!

New York, the State, is actually pretty conservative, if not outright Libertarian. However, democracy, being what it is? New York City rules the entire state. That’s a fact Jack! I think that is pathetic. Further, I think that the rest of New York should just pull up stakes, and secede from the city. Tell them to go take a hike,and form their own state. Much as my home state of California should be split into three entities… Or become parts of Nevada or Arizona…

Take a look at just what the minions of epic fail obama are trying to pull off in New York… As pissed as I get at the NRA? This should have been FRONT page at Gun Owners of America!

Laundry List of Anti-Gun Bills Introduced in the Empire State

Please contact your lawmakers and urge them to oppose the laundry list of anti-gun bills pending consideration in Albany prior to the Assembly’s annual “gun day.”  The package includes the following bills:

  • Assembly Bill 801A and its Senate companion, S 1598A, would require five-year renewals on pistol licenses.
  • Assembly Bill 1093 and its Senate companion, S 1715, would create liability for legal firearm retailers when criminals misuse firearms.
  • Assembly Bill 1275 and its Senate companion, S 1712, would outlaw the private sale and transfer of long guns.
  • Assembly Bill 1326 and its Senate companion, S 5228, would outlaw the sale of all handguns not equipped with so-called “child proofing” devices.
  • Assembly Bill 2881 and its Senate companion, S 2379, would ban the sale of common self-defense and hunting ammunition.
  • Assembly Bill 2884 would prohibit gun shows on public property.
  • Assembly Bill 2885 and Assembly Bill 2910 would establish standards for guns sold in the state and would allow the state police to prevent ANY firearm they deem unsafe from being transferred into the state.
  • Assembly Bill 3200 and its Senate companion, S 2953, would require ammunition coding or bullet serialization.
  • Assembly Bill 3346 would outlaw affordable handguns commonly used for self-defense.
  • Assembly Bill 3477 and its Senate companion, S 1188, would expand the failed 10-year-old ballistic imaging program to include even more firearms.
  • Assembly Bill 4441 and its Senate companion, S 4338, would prohibit the manufacture, sale or transfer of handguns not equipped with so-called “smart gun” technology.
  • Assembly Bill 5844 and its Senate companion, S 3098, would prohibit keeping firearms available for self-defense in the home.
  • Assembly Bill 6157 and Assembly Bill 6294 and their Senate companion, S 4084, would drastically expand the state’s ban on so-called “assault weapons” to include virtually all semi-automatic rifles and pistols that can accept detachable magazines.
  • Assembly Bill 6468B and its Senate companion, S 6005, would outlaw the sale of all semi-automatic handguns not equipped with so-called “microstamping” technology.
  • Senate Bill 4752 would ban certain firearms based upon bore diameter.

As the anti-gun agenda awaits activity, a few other measures deserve our support. They include Assembly Bill 5118A and its Senate companion, S 2430A, which would grant a tax exemption to conservation clubs and rod and gun clubs owning land having an assessed value of $500,000 or less. These bills are in the Assembly Real Property Tax Committee and the Senate Local Government Committee respectively.

NRA-ILA also supports Assembly Bill 7463A and its Senate Companion, S 3299A, which would expand hunting opportunities by allowing the use of a rifle to hunt deer or bear in certain parts of Chautauqua County.  These bills are pending in the Assembly and Senate Environment Committees, respectively.

Please contact your lawmakers and urge them to oppose the anti-gun bills pending in the Assembly and to support AB5118A/S 2430A, AB7463A/S 3299A in both the Senate and Assembly.

Gallup Confirms: Obama is still Gun Salesman of the year!

Gallup released poll results that confirm our contention that the President is indeed Gun Salesman of the year. While, as noted in the poll he himself has not proposed any firearms legislation, the legions of his minions certainly have, and he has not once. Not one single time said so much as a whisper in opposition to them. Whether it is something so drastic as giving away American sovereignty to the United Nations, or trying to control Mexico’s home grown endemic corruption and violence by destroying America’s Constitution he remains silent.

US MEXICO Assault on Freedom

A group of nitwits are at it yet again trying to restrict the liberty and freedom because Mexico can’t keep their own people in line. The cartels are using fully automatic weapons such as G3’s and FN’s along with M-16’s to tear things up. Not to mention hand grenades and other explosives.

Would somebody please point me to where in Wal Mart these items are located? Or anywhere else? Those are NOT semi-automatic’s!

US-Mexico groups urges new US assault weapons ban

MEXICO CITY — The United States should reinstate a Clinton-era ban on assault weapons to prevent such guns from reaching Mexican drug cartels, former officials from both countries said in a report released Tuesday.

The group, which includes two former U.S. ambassadors to Mexico, also said the U.S. should do more to stop the smuggling of firearms and ammunition into Mexico by stepping up investigations of gun dealers and more strictly regulating gun shows.

The Binational Task Force on the United States-Mexico Border listed the assault weapons ban as a step the U.S. should take immediately to improve security in both countries. The 10-year ban expired in 2004.

“Improving our efforts … will weaken the drug cartels and disrupt their illegal activities, and make it easier ultimately to dismantle and destroy them,” said Robert Bonner, co-chairman of the group and former head of both the U.S. Drug Enforcement Administration and Customs and Border Protection agency.

U.S. and Mexican officials say drug cartels frequently use assault rifles, which are banned in Mexico but easily purchased in the United States.

Mexican President Felipe Calderon launched a nationwide crackdown on drug cartels when he took office in December 2006. The offensive has been met with unprecedented violence, leaving more than 13,800 people dead.

During his run for office, President Barack Obama promised to push to reinstate the ban. He has since said he would rather enforce existing laws that make it illegal to send assault weapons across the border.

Other recommendations related to border security included restructuring Mexico’s law enforcement operations to create a counterpart to the U.S. Border Patrol, increasing U.S. assistance to Mexico to build up law enforcement and reducing demand for drugs in the United States through more treatment programs.

A mayor problem

The Texas Fred spitting match notwithstanding there appear to be more than a few Mayors across the country that are concerned about the Bloomberg Follies.

For example, Mayor Robert Shiner of Mentor, OH was listed as a member of MAIG, but Shiner hasn’t been Mayor since November 2008 and his office says he never agreed to be a MAIG member. Mayor Dale Strasser of Brunswick, Ohio found his name used in MAIG advertising when it was actually the Brunswick city manager, Robert Zienkowski, who signed up for the group. And Mayor Keith Hoffman of East Berlin, Ohio said his participation, which began about a month ago, resulted from a misunderstanding of the group’s objectives, and he is currently trying to get his name off the list. “It was a mistake really,” he said. “They swindle you in and then put your name on the list.”

According to the NRA, at least 30 mayors have appeared on the MAIG membership list despite the fact they were not mayors of the localities as advertised. More than 60 mayors have now removed their names. Many may have been misled by the Bloomberg organization or may have been added to the member list against their will or without their knowledge.

The Junk Science front

No, this time your tax money didn’t go to more man made global warming stupidity. But rather to a group that uses predetermined outcomes in order to bolster their failed belief that surrender is the way to go when your life is threatened.

One would think that a group of Doctors would seek proper treatment for their mental disease. There is hope for this devastating condition. Hoplobe’s resist your un-natural urges!

Now, more than at any other time in anyone’s memory, the federal government is in no position to waste taxpayer dollars on gun control advocacy “research.”  Nevertheless, the National Institutes of Health recently gave anti-gun researchers at the University of Pennsylvania School of Medicine $639,586 to conduct a survey intended to prove that possessing a gun doesn’t benefit assault victims.

Criminologist Gary Kleck calls the resulting survey “the very epitome of junk science in the guns-and-violence field—poor quality research designed to arrive at an ideologically predetermined conclusion.”

Here’s how it was done.  The Pennsylvania researchers surveyed only those assault victims who were shot, limited in the last six months of the survey to victims who were fatally shot.  It did not consider the far more numerous gun owners who used guns for self-defense successfully without being shot, nor crimes that were not even attempted because the criminals feared that prospective victims might be armed.

The survey was further limited to residents of urban Philadelphia who, according to the research, “were significantly more often Hispanic, more frequently working in high-risk occupations, less educated, and had a greater frequency of prior arrest,” compared to the rest of the population.  Victims who were shot in Philly, but who were not from Philly, were excluded too.  The survey considered a victim to be “armed” even if his gun was “in a nearby vehicle, or in another place.”

As Kleck says, “none of the evidence presented by the authors actually has any relevance to the issue of the effectiveness of defensive gun use, for the simple reason that at no point do they ever compare crime victims who used guns defensively with victims who did not.”  Kleck notes that other published research “reached precisely the opposite conclusions” reached by the NIH-funded survey.

What Kleck had in mind were the results of the federal government’s annual National Crime Victimization Survey, covering tens of thousands of assaults.  Kleck and others have reviewed those surveys and found that people who use guns to defend against assaults are less likely to be injured than people who use other means, or no means, of protection.

EDITORIAL: False reports about guns

CBS and MSNBC peddle phony stories about arms, race and violence

Many media outlets have misfired about guns. Countless newspapers and television networks — from CBS to MSNBC — have misreported that conservative protesters are threatening President Obama with guns at public events. It hasn’t happened.

In Portsmouth, N.H., a man carrying a gun, William Kostric, joined an Aug. 11 health care protest. This was blocks away and hours before Mr. Obama’s town-hall meeting in that city. Mr. Kostric was given permission to be on church property where the protest occurred and was not at the place the president visited. What most of the coverage left out was that Mr. Kostric didn’t carry his gun only for the protest; he legally carries a gun with him all the time for protection.

While the media regularly used terms such as “hotheads” to mischaracterize the situation, the coverage ignored that union members who opposed the protest had attacked Mr. Kostric and a friend, kicking, pushing and spitting on them. Despite violence against him by Mr. Obama’s supporters, Mr. Kostric did not draw his gun or threaten anyone.

On the CBS Evening News, Katie Couric asked, “Are we really still debating health care when a man brings a handgun to a church where the president is speaking?” Deliberately or not, she got the facts wrong. As we know, Mr. Kostric did bring a gun to the church, but the president was not there and never was scheduled to speak there. Mr. Obama spoke at a separate event at a local high school at a different time. Not letting facts get in the way of her hysterical story line, Ms. Couric linked Mr. Kostric’s gun to “fear and frankly ignorance drown[ing] out the serious debate that needs to take place about an issue that affects the lives of millions of people.”

In another case in Arizona, a black man staged an event with a local radio host and carried a semiautomatic rifle a few blocks away from another Obama town-hall meeting. According to the radio station, the staged event was “partially motivated to do so because of the controversy surrounding William Kostric.” This occurrence was not an example of an outraged gun-toting Obama protester, but a stunt to garner attention for a shock jock. Of course, this inconvenient truth was ignored by most news outlets.

MSNBC misrepresented the facts to try to back up a bogus claim about racism being behind opposition to Mr. Obama’s agenda. On Donny Deutsch’s Aug. 18 show about the Arizona town-hall meeting, the producers aired a clip of the anonymous black man carrying the so-called assault rifle — but the network edited the tape so the man’s race was obscured. Truth be damned, MSNBC anchor Contessa Brewer said, “There are questions whether this has a racial overtone. I mean, here you have a man of color in the presidency and white people showing up with guns strapped to their waists.” Another commentator on the same show worried about the “anger about a black person being president.” The supposed result: “You know we see these hate groups rising up.”

MSNBC’s irresponsible behavior is more than just bad journalism; it sows distrust between races. Ernest Hancock, the radio host who staged the event, was hoping to get some free publicity for himself and his show. Whatever one thinks of this PR stunt, it had nothing to do with race. MSNBC misrepresented a black man carrying a gun as a white man to invent a racial dynamic that didn’t exist.

Media disinformation about guns is a sad sign of the drastic action liberals will take to undermine support for gun rights for law-abiding citizens. It’s also an indication of liberals’ extreme desperation as Mr. Obama’s agenda unravels.
