First, Senator Arlen Specter provided the instrumental Republican
support to get anti-gun Attorney General Eric Holder confirmed by the
Senate.

Then, he singlehandedly pushed through the massive economic bailout, the
so-called stimulus bill, which contained several provisions of concern
to gun owners.

So it comes as no surprise that liberal anti-gun Specter, who has no
loyalty to the Constitution, also has no loyalty to the political party
that elected him.  Specter announced this week that he will leave the
Republican Party and run as a Democrat in 2010.

Specter's announcement comes only after poll after poll showed him
trailing pro-gun conservative Pat Toomey in a Republican primary.

Specter thinks that changing parties will improve his chances of winning
next year.

What he's going to learn is that the voters of Pennsylvania are much
more concerned about their Constitutional rights than they are with what
political party a candidate belongs to.

Every time Attorney General Eric Holder opens his mouth and talks about
reinstating the Clinton gun ban, gun owners know they have Arlen Specter
to thank.

Back in early January, Sen. Specter said he had "grave
concerns" about
Eric Holder.  He made it sound like he was going to join other pro-gun
Senators and oppose the Holder nomination.

Specter was only putting on a show.

After pretending to oppose Eric Holder, Sen. Specter provided the key
support that brought the nomination to the floor of the Senate.

Why the big switch?

Simple.  When it looked like Specter was going to face a primary
challenge from a real conservative, he talked tough and made it look
like he was opposed to Holder.  Then for a while, it appeared that
Specter would not have a serious challenge, so Specter flip-flopped and
decided not to oppose Holder.

With people like Specter in office, it's no wonder our gun rights are in
such jeopardy.

At least gun owners have a clear choice in the next election.  Former
Congressman Pat Toomey has again taken up the conservative, pro-gun
mantle and will challenge the liberal incumbent.

Specter was one of three Republicans whose vote was needed to pass the
bailout.  When one of the other two Senators expressed reservations,
good old Arlen Specter stepped in and brought that Senator "back in
line."

Without Specter, there would be no $1 TRILLION bailout.

Really, by the time debt services and other frills of the "socialism
bill" are accounted for, the cost will be over $3 TRILLION!

The debt foisted upon us by Arlen Specter will be passed on to
succeeding generations, AND the bailout is being used as a tool of the
anti-gun left.

You see, the bailout bill contains provisions that can fund anti-gun
activist organizations like ACORN and Moveon.org to the tune of hundreds
of millions -- even billions -- of your taxpayer dollars.

The bailout also contains provisions to require your doctor to
retroactively put your confidential medical records in a government
database.  Medical records have already been used to deny about 200,000
military veterans their Second Amendment rights, and that situation will
be made worse for all citizens thanks to the Specter bailout bill.

Perhaps no single Senator is negatively affecting the future of this
country more than Pennsylvania's Arlen Specter.

Rep. Toomey challenged Specter in a primary in 2004 with the support of
Gun Owners of America, and came just 1.7% short of winning.

Specter's bacon was pulled out of the fire only after the incumbent

community campaigned on his behalf at the last minute.

Well, Senator Specter has sold out the people of Pennsylvania and
conservatives across the nation for the last time.

Pat Toomey served in the U.S. House of Representatives for three terms,
before honoring a self-imposed term limit and retiring in 2004.

eastern Pennsylvania district he represented, Toomey stood firm on his
pro-Second Amendment principles.

Remember CANDIDATE Barack Obama?  The guy who "wasn't going to take away
our guns"?

Well, guess what?

Less than 100 days into his administration, he's never met a gun he
didn't hate.

A week ago, Obama went to Mexico, whined about the United States, and
bemoaned (before the whole world) the fact that he didn't have the
political power to take away our semi-automatics.  Nevertheless, that
didn't keep him from pushing additional restrictions on American gun
owners.

It's called the Inter-American Convention Against Illicit Manufacturing
of and Trafficking in Firearms, Ammunition, Explosives, and Other
Related Materials.  To be sure, this imponderable title masks a really
nasty piece of work.

First of all, when the treaty purports to ban the "illicit"
manufacture
of firearms, what does that mean?

1. "Illicit manufacturing" of firearms is defined as
"assembly of
firearms [or] ammunition... without a license...."

Hence, reloading ammunition -- or putting together a lawful firearm from
a kit -- is clearly "illicit manufacturing."

Modifying a firearm in any way would surely be "illicit
manufacturing."
And, while it would be a stretch, assembling a firearm after cleaning it
could, in any plain reading of the words, come within the screwy
definition of "illicit manufacturing."

2. "Firearm" has a similarly questionable definition.

"[A]ny other weapon" is a "firearm," according to
the treaty -- and the
term "weapon" is nowhere defined.

So, is a BB gun a "firearm"?  Probably.

A toy gun?  Possibly.

A pistol grip or firing pin?  Probably.  And who knows what else.

If these provisions (and others) become the law of the land, the Obama
administration could have a heyday in enforcing them.  Consider some of
the other provisions in the treaty:

* Banning Reloading.  In Article IV of the treaty, countries commit to
adopting "necessary legislative or other measures" to criminalize
illicit manufacturing and trafficking in firearms.

Remember that "illicit manufacturing" includes reloading and
modifying
or assembling a firearm in any way.  This would mean that the Obama
administration could promulgate regulations banning reloading on the
basis of this treaty -- just as it is currently circumventing Congress
to write legislation taxing greenhouse gases.

* Banning Gun Clubs.  Article IV goes on to state that the criminalized
acts should include "association or conspiracy" in connection
with said
offenses -- which is arguably a term broad enough to allow, by
regulation, the criminalization of entire pro-gun organizations or gun
clubs, based on the facilities which they provide their membership.

* Extraditing US Gun Dealers. Article V requires each party to "adopt
such measures as may be necessary to establish its jurisdiction over the
offenses it has established in accordance with this Convention" under a
variety of circumstances.

We know that Mexico is blaming U.S. gun dealers for the fact that its
streets are flowing with blood.  And we know it is possible for Mexico
to define offenses "committed in its territory" in a very
broad way.
And we know that we have an extradition obligation under Article XIX of
the proposed treaty.  So we know that Mexico could try to use the treaty
to demand to extradition of American gun dealers.

Under Article XXIX, if Mexico demands the extradition of a lawful
American gun dealer, the U.S. would be required to resolve the dispute
through "other means of peaceful settlement."

Does anyone want to risk twenty years in a sweltering Mexican jail on
the proposition that the Obama administration would apply this provision
in a pro-gun manner?

* Microstamping.  Article VI requires "appropriate markings" on
firearms.  And, it is not inconceivable that this provision could be
used to require microstamping of firearms and/or ammunition -- a
requirement which is clearly intended to impose specifications which are
not technologically possible or which are possible only at a
prohibitively expensive cost.

* Gun Registration.  Article XI requires the maintenance of any records,
for a "reasonable time," that the government determines to be
necessary
to trace firearms.  This provision would almost certainly repeal
portions of McClure-Volkmer and could arguably be used to require a
national registry or database.

ACTION:  Write your Senators and urge them to oppose the Inter-American
Convention Against Illicit Manufacturing of and Trafficking in Firearms,
Ammunition, Explosives, and Other Related Materials.

Dear Senator:

I am urging you, in the strongest terms, to oppose the Inter-American
Convention Against Illicit Manufacturing of and Trafficking in Firearms,
Ammunition, Explosives, and Other Related Materials.

This anti-gun treaty was written by international bureaucrats who are
either stupid or virulently anti-gun -- or both.

This treaty could very well ban the ability to reload ammunition, to put
new stocks on rifles lawfully owned by American citizens, and, possibly,
even ban BB guns!

There are too many problems with this treaty to mention them all in this
letter.  The rest can be read on the website of Gun Owners of America

Please do not tell me the treaty has not yet been abused in this way by
the bevy of Third World countries which have signed it.  We do not
expect the real ramifications of the treaty to become clear until the
big prize -- the U.S. -- has stepped into the trap.

For all of these reasons, I must insist that you oppose ratification of
the treaty.

CIFTA, and the NRA

CIFTA is yet another attempt by those that hate American freedom and liberty to undermine our Constitution and Bill of Rights. The NRA acts yet again like a broken clock. I can’t wait for the G.O.A. assessment…

During an official visit to Mexico on April 16, President Obama announced his support for Senate ratification of an inter-American treaty on firearms trafficking. In response, NRA Executive Vice President Wayne LaPierre and NRA-ILA Executive Director Chris Cox issued the following statement:

“The NRA is well aware of the proposed Organization of American States treaty on firearms trafficking, known by its Spanish initials as CIFTA. The NRA monitored the development of this treaty from its earliest days, but contrary to news reports today, the NRA did not ‘participate’ at the meeting where the treaty was approved.

“The treaty does include language suggesting that it is not intended to restrict ‘lawful ownership and use’ of firearms. Despite those words, the NRA knows that anti-gun advocates will still try to use this treaty to attack gun ownership in the U.S. Therefore, the NRA will continue to vigorously oppose any international effort to restrict the constitutional rights of law-abiding American gun owners

President Obama Continues Assault on the Second Amendment

President Obama is determined to eradicate the Second Amendment rights of law-abiding American citizens.

In recent meetings with Mexican President Felipe Calderón, the American President promised to urge the U.S. Senate to pass an international arms control treaty.

The treaty, cumbersomely titled the “Inter-American Convention Against the Illicit Manufacturing of and Trafficking in Firearms, Ammunition, Explosives, and Other Related Materials” (known by the acronym CIFTA), was signed by President Bill Clinton, but never ratified by the Senate.

President Obama is hoping to capitalize on an increased Democrat majority and push its quick ratification.  The U.S. is one of four nations that have not ratified the treaty.President Obama with Mexican President  Felipe Calderón

If ratified and the U.S. is found not to be in compliance with any provisions of the treaty — such as a provision that would outlaw reloading ammunition without a government license — President Obama would be empowered to implement regulations without Congressional approval.

Supporters of CIFTA claim the treaty is not a threat to the Second Amendment, but only a “symbolic” gesture.  But symbolic of what?  That America really is to blame for problems of violence and drug gangs in a foreign country?  That the American government can be pressed by a foreign country to alter the Second Amendment?

If the kind of “change” that Obama wants is for the United States to take its marching orders from third world countries regarding our gun rights, we’re in big trouble!

The fact is, this treaty will do NOTHING to combat the violence in Mexico, but it will go a LONG WAY toward eroding our ability to protect the right to keep and bear arms through our elected officials. [Read more about CIFTA]

Sheriff Joe Arpaio for Homeland Security Chief!

With all the nonsense being uttered by political leaders who are blaming American gun owners for the violence in Mexico, it’s refreshing to hear at least one elected official offer some common sense: Sheriff Joe Arpaio of Maricopa County, Arizona.

Sheriff Joe ArpiaoSheriff Arpaio takes his oath of office to protect and defend the U.S. Constitution seriously. He is also fully committed to doing his part to protect our homeland from people who are here illegally. In fact, the Sheriff would make quite an effective Director of Homeland Security.

Employing more than 3,000 people, Arpaio runs the nation’s third largest Sheriff’s office in the fourth most populous county. He has gained fame over the years for tough, no-nonsense law-enforcement tactics.

When faced with a shortage of cells, Arpaio bought army surplus tents and surrounded them with a barbed wire fence. He also upset the soft-on-crime crowd by “outrageous” actions such as banning smoking and pornography and requiring inmates to wear pink underwear. And he actually makes prisoners work on roads and other manual labor. Inmates are in prison, after all, not in day care.

Arpaio is most well known for his strong stance against illegal immigration. In 2005, Arizona made smuggling illegal aliens a state felony. That action empowered officers such as Sheriff Arpaio to enforce immigration law, something at which the federal government has failed miserably.

But perhaps what enrages the anti-gun liberal establishment the most — though it almost never makes the news — is that Sheriff Arpaio actually believes in the Second Amendment and he trusts average citizens with firearms! Arpaio deputized citizen volunteers from every walk of life and income bracket. These citizen-volunteers patrol malls, arrest graffiti violators, dead beat parents, and even illegal aliens. The volunteers furnish their own airplanes, jeeps and horses — and they are armed. [Read more about Sheriff Joe!]

Thank you for your activism last week on the budget resolution,
especially given the short notice.  (Please realize that GOA has no
control over when votes are scheduled, so sometimes we have to alert you
with little time before the vote takes place!)

While the budget resolution for fiscal year 2010 has now passed the
Senate and the House in different forms, we were able to secure some
significant victories in the Senate.

First, with 64 favorable votes, the Senate passed an amendment by Sen.
Roger Wicker (R-MS) to force the federally subsidized Amtrak to allow
passengers to carry  firearms in checked bags.

In addition, the Senate adopted an amendment offered by Senator James
DeMint (R-SC) to prohibit any system of nationalized health care which
would prevent Americans from being able to select their doctors and
insurance companies.

This amendment could make it more difficult to institute either
socialized medicine or a Massachusetts-style insurance that requires
everyone to purchase [government approved?] insurance.

This is good news for gun owners.  A "mandated" insurance 
system could
not only cost you up to $1,000 month, but could also result in your most
sensitive personal information being placed in a medical database --
information that could easily be used to put more names on the gun
prohibition list (NICS).

The budget resolution now goes to conference committee, where
anti-gunners are expected to strip out both of our pro-gun amendments.
But these amendments did pin senators down on important issues early in
the budget war, which was an important strategic objective.

It is unclear when the conference report on the budget resolution will
be sent back to the Senate and the House.  One possibility is that the
resolution will be held in conference until September.

The Democrat leadership has ominously threatened to produce a bill that
would require mandatory health insurance.

They are not talking about this openly, but as a recent editorial in The
Washington Post confessed:  "Though only some of the players [on Capitol
Hill] will say so now, the [health care] plan will ultimately include a
mandate requiring everyone to have insurance." (April 6, 2009)

You see, the power players on Capitol Hill are not admitting this openly
because the American people oppose it. But if they set in motion a
process to help sneak such a "mandate" into law, then gun 
owners will
only have a few weeks to stop it in September.

This is why we need to keep the pressure on liberty-leaning Senators
during the ensuing months.  Please stay tuned.

Olofson Update

David Olofson continues to languish in prison for a malfunctioning
rifle.  GOA attorneys made oral arguments before the federal appeals
court in Chicago on January 23.  They pointed out that the government
withheld from the jury that the Supreme Court itself, along with a
government training manual, has made it clear that a gun functioning
like Olofson's was not a machine gun but simply a malfunctioning gun.

If this decision is not overturned, any owner of a semi-automatic
firearm could find himself sitting in jail next to David Olofson.

Generous individuals have made monthly commitments of $10 a month (or
more).  This has enabled Candy Olofson to take care of their three kids
and keep her job as a nurse without having to get a second job.  The
Olofson Relief Fund has been making the monthly payments of
approximately $1300 combined for the family car and mortgage.

Understandably, some have had to stop making their monthly

Do you agree with people like Bill Clinton and Barack Obama, who treat
the Second Amendment as if it were written only to protect your ability
to go hunting and target shooting?

Or do you agree with Gun Owners of America, George Washington and Thomas
Jefferson, who believe that the Second Amendment protects a pre-existing
fundamental right that is essential to the preservation of liberty?

Well, a whole lot of people in Congress are claiming to protect your
Second Amendment rights, but all they’re really doing is protecting your
hunting season.

We’re talking about the Omnibus Public Lands Act. You helped to defeat
this bill last week in the House, but Congressional leaders have vowed
to bring it up again soon.

S. 22 is an enormous package of over 190 bills lumped together with a
price tag of $10 billion. The bill will greatly expand the amount of
land controlled by the National Park Service, thus spreading the
agency’s unconstitutional gun regulations to more areas.

Fear of upsetting gun owners — who helped elect many members of
Congress from both parties — kept this bill off the floor for several
weeks.

Then, in a meeting last Tuesday, not held in an open committee hearing
but behind closed doors, House leaders brokered a deal with some
supposedly pro-gun Democrats.

They said they were concerned about your gun rights. They said they
were going to “fix” the bill.

But they did not address the NPS anti-gun regulations that prohibit
carrying a firearm for self defense without a government issued
concealed carry permit.

What did they do? They added language to the bill to say you can still
go hunting.

That’s right. Many Congressmen claimed to be protecting the Second
Amendment, when all they were really doing was thumbing their noses at
self defense.

Here is the entire “pro-gun” amendment that was considered in
the House.
Judge for yourself if this really protects your Second Amendment rights:

“Nothing in this Title shall be construed as affecting the authority,
jurisdiction, or responsibility of the several States to manage,
control, or regulate fish and resident wildlife under State law or
regulations, including the regulation of hunting, fishing, trapping, and
recreational shooting. Nothing in this Title shall be construed as
limiting access for hunting, fishing, trapping, or recreational
shooting.”

They may as well have called it the “Elmer Fudd Protection Act.”

A lot of people who voted for this bill campaigned for office as
champions of gun rights. They said “Send me to Washington; I’ll fight
for the Second Amendment.” And this is what we get? Pathetic.

But let’s be clear. The issue is not just about the NPS gun
restrictions, as bad as they are. And whether or not you personally use
federal land is not the point.

What is important is the disdain with which legislators hold your Second
Amendment rights.

It is imperative that you speak up on this issue. The outcome of this
battle will be a preview of what we can expect for the next two years.
Will your gun rights be comprised away little by little? Or will we
stand together and hold legislators accountable to their campaign
promises to uphold the Second Amendment?

This week there may be several votes in both the Senate and House on the
Omnibus Land bill.

Congressional leaders plan to act quickly in an attempt to ram this down
the throat of the American people without a fair and open process. They
desperately want to avoid any amendment that would truly protect your
gun rights.

Congress hopes to leave the gun ban in place, and enlarge the areas
affected by it. For example, the bill expands existing park land,
creates new national trails that will fall under the gun restrictions,
and authorizes the federal government to buy more land adjacent to
national parks and trails.

House and Senate leaders plan to move on this bill rapidly, although
they are ambiguous about the process.

But our message to Congress is simple: Stop playing around with our
Second Amendment rights!

We don’t care about the process. We care about the Second Amendment.
And we mean ALL of the Second Amendment, not just hunting.

Tell Congress you expect them to protect your right to keep and bear
arms without compromising. Please take a few seconds and send the
pre-written message below.

When you’re done, become a force multiplier. Send this alert to a few
friends.

It is important that you take this action because right now GOA is the
only gun rights organization speaking out for ALL of your Second
Amendment rights.

We’ve all forwarded jokes or funny pictures to our friends. How about
forwarding a message to help protect our God-ordained constitutionally
protected right to keep and bear arms?

And please do not think your voice won’t be heard. Remember, this bill
failed to pass the House by just two votes last week because people like
you took action.

Congressmen need to know that their votes in the coming days will impact
YOUR vote next year. But if they don’t hear from you and they think
you’re not looking, many will treat your rights with contempt.

We’re not alone in this battle. In the Senate, pro-gun champions such
as Sens. Tom Coburn and Jim DeMint are prepared to lead the fight
against this bill.

In the House, Reps. Paul Broun, Rob Bishop and Doc Hastings are among
those fighting hard for your gun rights.

In fact, there are many in Congress willing to stand up for the Second
Amendment, but they are repeatedly squashed by the anti-gun leadership
or undermined by pro-gun compromisers. Pro-gun Congressmen who want to
repeal the gun ban are being told, in effect, to “Shut up and
vote!”

Friends, we know we’ve asked for a lot of action from you already this
year.

Unfortunately, that is not going to stop. But we will all draw the line
at some point. Let’s work together and do it now.

Thank you for working with Gun Owners of America. Our effectiveness in
Washington depends on your activism. PLEASE try to get your pro-gun
friends and family involved. Now more than ever, every voice is
critical.

The Omnibus Public Land Act of 2009 is expected to come to the floor
soon.

I urge you to oppose this bill if, as expected, the leadership does not
allow an amendment to repeal the anti-gun regulations of the National
Park Service.

Recent changes made by the Interior Department only allow persons with a
concealed carry permit to possess a self-defense firearm on NPS land.
Non-permit holders are still prohibited from carrying a firearm for
their protection.

And please don’t be fooled by a supposedly pro-gun amendment to
“fix”
the bill that was brought up last week during the House debate on S. 22.
That language only modestly protects hunting and recreational shooting.

While protecting the rights of sportsmen is important, the Second
Amendment is NOT about hunting rights. I am more concerned about my
ability to defend my life, and the lives of my loved ones, than I am
about plinking cans.

Congressional leaders have been ambiguous about how this legislation
will come to the floor, but my message to you is clear: protect ALL of
my Second Amendment rights.

Please OPPOSE final passage on any land bill that does not repeal the
NPS gun ban.

Unintended Consequences… I seriously doubt that!

Regular readers are aware that I am doing something  that is apparently below the pay grade of Congress-persons and Senators.I am actually attempting to read this entire so-called stimulus bill. Others, bless them, are already zeroed in  on the obvious conflicts with freedom and liberty. Reading, and even more importantly interpreting this abomination (Obaminazition?) is worse than learning the Kreb’s Cycle under Gerry Gordon M.D. in Paramedic school!

In any case Gun Owners of America has already hit the ten ring on at minimum some of this veritable beast that I believe may very well catapult the United States into irrevocable balkanization, if not revolution. I pray that secession this time will be Constitutional, and bloodless.

It was a day that will live in infamy.

President Obama traveled to Denver, Colorado yesterday to sign the
multi-billion dollar, pork-laden, so-called “stimulus” bill
into law.

But forget the $787 billion price tag you heard on TV. Forget the $12
TRILLION debt limit which the bill created.

By the time debt services and other frills of the “socialism
bill” are
accounted for, the cost will be over $3,000,000,000,000 (yes, three
TRILLION).

This makes the bill the biggest government spending grab in human
history.

But what about the details? The hundreds and hundreds of pages in the
bill were not made available until less than 18 hours before the final
passage vote. But here’s what we know in relation to the gun-related
provisions:

* The final bill continues to spend between $12 and $20 BILLION on
requiring your doctor to retroactively put your most confidential
medical records into a government database. Based on our experience
with veterans, we would expect the government to try to use computerized
psychiatric records to impose gun bans on people who have sought (or
will seek) treatment.

* The final bill continues to fund liberal community action groups like
ACORN, which, you may remember, engaged in massive criminal election
fraud on behalf of Barack Obama’s presidential candidacy and also was
involved in anti-Second Amendment activism in New Jersey.

White House Chief of Staff Rahm Emanuel was at least honest when he said
it would be a shame to let a crisis like the current recession “go to
waste.” Like vultures picking on the nation’s carcass, the White House
has used the nation’s pain to lavish largesse on its political
supporters, at the expense of the nation’s economic survival.

And, in the end, this act of ethical depravity was made possible by
every Democrat Senator who voted for the bill, plus the defections of
three Republicans: Arlen Specter (R-PA), Olympia Snowe (R-ME), and
Susan Collins (R-ME).

If there is one silver lining to all of this, it’s the debunking of a
rumor that recently swept across the internet. The rumor claimed that
the provisions of HR 45 — the massive gun registration bill introduced
by Chicago congressman Bobby Rush (D) — were “rolled into”
what was
passed.

But having searched the contents of the new law, GOA staff has
determined the rumor appears to be false.

GOA wants to thank all of you for your hard work in opposing the
extremely anti-gun Eric Holder for Attorney General.

While we lost the battle on Monday (by a vote of 75-21), you guys
registered your opposition loud and clear.

There is no doubt that your activism truly made gun rights THE issue in
this nomination battle. Every Senator who spoke against Holder
mentioned Second Amendment fears. And even among many of the Senators
who voted for him, there was tremendous concern regarding Holder’s
stance on gun rights.

As stated by The Washington Post yesterday, “Holder overcame concerns by
a small but vocal group of GOP lawmakers about his position on national
security and GUN RIGHTS, as well as his recommendations in two
controversial clemency decisions by President Bill Clinton.”

This was truly a battle worth fighting. In fact, the man who was being
deified two weeks ago is now the very same President who is widely seen
as not being able to shoot straight in selecting cabinet members and is
already starting to lose public support. The battle over Holder was
certainly central to taking the bloom off this rose.

So thank you for helping magnify our voice on Capitol Hill. GOA spent
many hours lobbying against Holder, as we were the only gun rights group
in Washington to tell Senators we would be rating this vote in our
end-of-session grade report.

With Holder in office, you can expect to see renewed efforts to drive
gun dealers and manufacturers out of business — similar to the efforts
he supported while in the Clinton administration.

Expect also to see attempts to classify more guns as “not
suitable” for
sporting purposes. And don’t be surprised to see attempts to use the No
Fly List to disqualify gun owners from exercising their Second Amendment
rights. (Bureaucrats can add innocent Americans to the No Fly List —
and have done so — without any due process of law being followed.)

With Eric Holder at the helm, the list could easily become a No Gun
List, as there are already discussions in Washington about doing this.

All the above horror scenarios are policies that could conceivably occur
without ANY legislation being passed in Congress. That is what makes
Holder’s confirmation as Attorney General so dangerous. Through the use
of Executive Orders or by prosecuting gun owners, Holder can inflict
much damage upon the Second Amendment — even apart from lending his
support for legislation, such as renewing the semi-auto ban.

So what can we do now? Is the battle over Holder finished?

No, not yet. There’s one more action item that needs to be taken.
There are 75 Senators who ignored your pleas to vote against Holder.
They need to hear from you and know that you’re upset.

They need to be reminded again and again that voting for gun control is
what cost Bill Clinton’s party the control of Congress in 1994… and Al
Gore his election in 2000… and John Kerry the presidency in 2004.

And don’t forget, there are the 21 Senators who voted right. They need
to be thanked. So please don’t file this alert until you’ve taken the
action item below.

code, which will then bring up the correct letter for your Senators.

Gun Owners Foundation (GOF) already has filed not one, but two friend
of the court briefs for Ignacio Ramos and Jose Antonio Compean. In
those briefs, GOF has pointed out to the Fifth Circuit Court of
Appeals that the 10-year conviction of the two agents is for a crime
which doesn’t exist.

The two agents were convicted of the “Discharge of a Firearm in
Relation to a Crime of Violence” — something which is not an
offense, rather it is a sentencing enhancement after the government
has established illegal gun possession, use or carrying.

Of course, if the Feds had gone for that kind of charge, they would
have run into the problem that the agents were required to possess,
use and carry guns on them while on duty. That is why the US
Attorney, Johnny Sutton, went for, and succeeded, in making up an
offense that would not force him to explain away that the agents are
required to be armed.

One of the reasons the Border Patrol requires agents to be armed is
so they can use their guns against armed drug smugglers such as
Osvaldo Aldrete.

Even if the Supreme Court reverses this injustice done to Ramos and
Compean, they could expect to sit in jail for upwards of another two
years — for a crime that was impossible for them to commit.

GOF was a friend of the court in a similar case before the Supreme
Court. Our position was upheld nine-to-nothing. It involved a drug
dealer who took a gun in payment for a bag of dope. The Feds gave
him many extra years because he supposedly had “used” a gun in a
crime. The Supreme Court agreed that such a view was ridiculous and
clearly not the intent of the law. The Fifth Circuit has simply
overlooked these fatal flaws in the government’s case.

George Bush is thinking about his legacy. We have a chance to
convince him that his legacy is on the verge of staining his
reputation with the miscarriage of justice perpetrated by the federal
prosecutor, Johnny Sutton. Keep in mind that Sutton lied to the
trial court and to the appeals court about Aldrete’s connections with
the drug trade. He also concealed from the jury that he was paying
Aldrete for his testimony against the agents.

Hopefully, President Bush does not want to be known as one who stood
by while innocent men — and the wives and children — suffered
because of a blatant injustice.

All gun owners should be alarmed at what the government has done to
these two agents. If they will do this to police officers, we cannot
assume they will treat the rest of the population any better. The

I am shocked that Border Patrol agents Ramos and Compean are still in
jail. Their conviction on the ten-year count was fraudulent. There
is no such crime as “firing a gun in a federal crime.” That is only
an enhancement for other felony charges — for example, reckless
endangerment.

Essentially, Ramos and Compean — to get this sentencing enhancement
— would have had to illegally possess their firearms and recklessly
endanger the drug smuggler they shot. But isn’t the possession of
firearms part of their job description?

Please pardon these men in time for Christmas.

rights from being eliminated by a Congress controlled by people like
Ted Kennedy, Chuck Schumer, Carolyn McCarthy and other notorious gun
grabbers.

Even so, despite all the hurdles that we see ahead, one should not
forget that 2008 was a real improvement for gun rights in many
respects. Gun Owners of America experienced victories in the
courts… in the Congress… over federal bureaucracies… and in the
states.

The following victories are just a few of the accomplishments that
GOA was able to achieve this year with YOUR HELP. So let’s take a
look at our work together, month by month.

January – February

* As the new year dawns, President Bush signs the Veterans
Disarmament Act (a.k.a. the NICS Improvement Amendments Act). This
legislation codifies illegitimate procedures that, over the past
decade, had already resulted in almost 150,000 veterans being denied
the right to buy guns because battle-related stress has supposedly
rendered them unable to manage their own financial affairs.

GOA was able to win some significant concession in the bill, even as
we were trying to kill it outright. Unfortunately, the bill passed
both houses of Congress last year without a vote. Republican Senator
Jim DeMint of South Carolina later complained that the Democrat
controlled Senate had passed 94 percent of its bills this year
without a recorded vote.

* An Associate Director in the U.S. Interior Department defends the
National Park Service ban claiming that “parks are safe places” and
that right to carry laws “do not reduce crime” or protect people
against dangerous wildlife. GOA responds by generating thousands
upon thousands of postcards into the Oval Office, asking President
Bush to put the squeeze on Interior Secretary Dirk Kempthorne to get
the NPS ban reversed — a reversal that will come about in May.

* The U.S. Solicitor General files a brief with the U.S. Supreme
Court in the D.C. v. Heller case arguing that categorical gun bans of
virtually all self-defense firearms are constitutional if a court
determines they are “reasonable” — the lowest standard of
constitutional review. This view could justify a national ban on all
firearms, including a ban on all hunting rifles.

GOA works with Rep. Virgil Goode (R-VA) and helps him to quickly get
57 additional congressmen to oppose the Solicitor General’s opinion.

* Because of generous contributions from its members, GOA is able to
submit a very unique amicus brief before the U.S. Supreme Court in
defense of Dick Anthony Heller, who was denied the right to own a gun
in the nation’s capital as a result of the draconian gun ban which
exists there.

In this hard-hitting brief, GOA takes aim at the weak arguments put
forth by both the DC government and the Bush Administration. But
more than that, GOA examines the favorable text and context of the
Second Amendment in great detail, while also documenting the pro-gun
history that formed the backdrop of its inclusion into the Bill of
Rights.

March – May

* After looking at all the briefs which have been submitted in the
Heller case, the editors at USA Today decide to use GOA for the
opposing voice on March 19. The paper’s editors tell our attorneys
that GOA had an argument that was clearly distinctive, as we were the
only ones to argue that the words “shall not be infringed”
invalidated all federal gun control laws.

* In the states, GOA helped Utah, Wisconsin and Wyoming to pass
Emergency Protection bills throughout the country. These bills
repeal laws that allow police to confiscate firearms during a
declared emergency, such as what occurred in New Orleans after
Hurricane Katrina decimated the city in 2005.

The sponsor of the Utah legislation, Senator Mark Madsen (R), thanked
GOA in March for the help we offered in helping pass the legislation
in his state.

“GOA supplied me with video that documented the plight of decent gun
owners in New Orleans who had their guns stolen by police after
Hurricane Katrina,” Madsen said. “The DVD was very helpful in
educating other members of the Utah legislature, and my bill to
protect Utah gun owners from gun confiscation, SB 157, passed by
overwhelming margins.”

Sen. Madsen’s new law is one of the best in the country. If someone
were to have his gun illegitimately confiscated, that person could
not only sue for damages, but could hold the offending officer and
his superior personally liable.

* GOA’s attorneys uncover a proposal in April to keep gun owners from
shipping replica or inert munitions through the mail. GOA
immediately submitted a blistering critique to the U.S. Post Office
and contacted thousands of grassroots activists so they could submit
their own comments as well. To date, the agency has backed off of
its original gun control proposal.

* The Bush administration, after more than seven years, has finally
issued regulations permitting the carrying of firearms in national
parks! Beginning in 2009, gun owners will be able to carry firearms
according to the laws of the state in which the park is located.

* GOA learns about Pastor Phillip Miles of South Carolina, who was
sentenced to three years in a Russian prison for carrying a single
box of hunting ammo in his luggage, intended as a gift. GOA urges
President Bush and Secretary of State Condoleeza Rice to intervene on
Miles’ behalf, as the sentence definitely did not fit the “crime.”
Russian authorities succumb to the outcry shortly thereafter… Miles
is released in June and returns to the United States.

June – August

* The Supreme Court strikes down the DC gun ban! While not perfect,
the Court’s decision recognizes that the Second Amendment protects an
“individual right” and states that the decades-old ban in the
nation’s capital is unconstitutional.

GOA’s brief had countered both the DC government and the Bush
Administration — as the latter had asked the Court to use the DC
case as a justification for all sorts of gun control. GOA is pleased
that the Justices heeded our admonition to limit the Court’s holding
to the case before it, thus shooting down both the DC government and
the Bush Administration in their quest to validate other firearms
restrictions.

* GOA Executive Director Larry Pratt escorts David Olofson to a
federal prison in Minnesota. Olofson was convicted in federal court
of transferring a malfunctioning semi-automatic firearm which the ATF
claimed was machine gun — a determination that should concern every
gun owner who owns a semi-auto.

Gun Owners of America becomes the lead gun organization fighting
against the ATF’s persecution of Olofson. In taking on this case,
GOA is also defending the rights of gun owners who could be
prosecuted for owning a malfunctioning firearm. For the ATF, a gun
that misfires is an excellent opportunity to rack up an easy
conviction on an illegal machine gun charge.

In Olofson’s defense, GOA submits an appeal challenging his
conviction at the district court level, and sets up a relief fund to
help pay for his family’s mortgage and car payments.

September – November

* David Olofson’s wife, Candy, thanks GOA and its members for helping
their family. Candy tells GOA Executive Director Larry Pratt that
because of the financial help that GOA members have given, she has
not had to get a second job, so she is able to spend time being a
Mom.

* GOA’s Larry Pratt travels to the Big Easy to award a brand new
handgun to Patricia Konie — the New Orleans resident who was tackled
and disarmed by police in the wake of Hurricane Katrina. Konie was
forced to evacuate her home in the wake of Hurricane Katrina in 2005,
and until recently, had remained disarmed. To this day, she has
never gotten back her stolen gun.

* GOA tells its email activists how the ATF was trying to prevent the
distribution of an electronic 4473 Form. This software has been
developed by a private firm, Coloseum Software Corporation, and is
intended to protect dealers against the “mistakes” that have
allowed
the ATF to prosecute or harass them into giving up their licenses.

GOA issued a grassroots alert in mid-October explaining how the ATF
had been dragging its collective feet for months — keeping Coloseum
from distributing its software, even while the ATF was developing its
own competing software (and possibly, violating the copyright which
belonged to Coloseum).

After GOA asked gun owners to contact the Bush Administration, the
owner of Coloseum contacted us shortly thereafter to tell us that our
alert had been a tremendous success: “After the GOA alert put the
spotlight on criminal activity by the BATFE, they quickly provided us
[Coloseum Software Corp] with the required documentation for the new
Form 4473 which we had been asking for months.”

Eric Holder. Holder signed on to an amicus brief in the Heller case
which SUPPORTED the DC ban on handguns and the ban on using any
firearm for self-defense in a person’s home. Holder’s brief also
argued that the Second Amendment protects a “collective” right, not
an individual right (as the Supreme Court eventually ruled).

* And based on his pick for Chief of Staff, you can be sure that the
Obama administration will use any “crisis” it can to push its gun
control agenda. Obama’s Chief of Staff, Rahm Emanuel, told the Wall
Street Journal recently that, “You never want a serious crisis to go
to waste…. [A] crisis provides the opportunity for us to do things
that you could not do before.”

Get it? Every time a crackpot goes on a shooting spree, the Obama
administration is going to use that “crisis” to come after
your guns!
