Harry Reid to Take One Last Shot at the Second Amendment in the Lame Duck Session

There’s a reason why we at GOA call the post-election period of Congress the “slime duck” session.

Harry Reid and his minions now will try to shove down our throats all of the anti-gun legislation and nominees they were afraid to reveal before the elections — when voters still had the option to punish them by throwing them out of office.

As it turns out, gun owners in most states knew exactly what Reid had in mind when they went to the polis on November 4.  And, as a result, anti-gun hypocrites like Arkansas’ Mark Pryor, Louisiana’s Mary Landrieu, North Carolina’s Kay Hagan, Alaska’s Mark Begich, and Colorado’s Mark Udall are pretty much “dead ducks.”

The question is: Will these anti-gun liars be given the power to make virtually all budgetary gun decisions on the giant government-funding bill (the “continuing resolution” or “CR”)?

And will they get to shove through an anti-gun successor to Attorney General Eric Holder in December under Harry Reid’s “nuclear option” fraud rules … where the discredited and repudiated Democratic anti-gun “slime ducks” will make the decision … and where Harry Reid won’t need a single Republican vote?

On the “CR” issue, government funding is set to expire on December 11, so a new bill will be necessary.

But Congress has a choice of whether to fund it for almost an entire year — or to kick it over to February or March, when the newly elected pro-gun senators will have an opportunity to have some say in a giant bill which makes virtually all policy decisions for the government.

For instance, the “CR” will decide whether or not the Schumer amendment prohibiting relief from disabilities will be renewed. It will decide whether to defund the shotgun import ban, the ammunition import ban, the illegal multiple sale reporting requirements, the implementation of the Arms Trade Treaty, and Operation Choke Point.

We would much rather have incoming Iowa Senator Joni Ernst make these decisions than her anti-gun predecessor, Tom Harkin.

One more thing: About April 15, millions of Americans will realize (perhaps for the first time) that they have been assessed a fine of hundreds of dollars for not complying with the anti-gun ObamaCare law.

Gun owners despise this law because of concerns that a national health database could be used by federal bureaucrats to disarm law-abiding Americans, in the same way that more than 175,000 military veterans have already been disarmed.

But this April 15 will hit millions of additional Americans in the pocketbook.  At that time, Republicans will want a legislative vehicle (such as a “CR”) to block IRS enforcement of this wildly unpopular mandate. But, if Congress gives Obama a carte blanche through September 30, this will not be an option.

Before the new Congress is sworn in — this coming January — the Republicans are still in the minority in Harry Reid’s Senate.  Thus, the most effective course of action would be to convince House members — and especially Speaker John Boehner — to refuse making any long-term deals on the CR.

This will give the new, pro-gun members of Congress who arrive in January a stronger hand in using the CR to protect gun rights.

ACTION: Recognizing that a lot of gun policy is “hidden” in the Continuing Resolution, urge your Representatives to OPPOSE any long-term CR.  Insist that any CR they agree to in December must expire (or be reconsidered) before April of next year.

The Battle of Athens: Time for another in your face confrontation?

The more that some public officials overstep their authority, the more that voters — and others — are stepping up and saying, “Stop!”

The 2014 congressional elections represented a collective shout by voters to politicians and bureaucrats to back off.  Way off.

Consider the case of Arnold Abbott, a 90-year old involved in feeding the needy at the Sanctuary Church in Fort Lauderdale, Florida.  This “scofflaw” is a serial free food dispenser to the poor who come to his church for meals.  

Abbott was arrested by the Ft. Lauderdale police for his supposed threat to the peace of society.  During the arrest, an officer shouted to Arnold, “Drop that plate right now!”

You read that right.  Arnold was not told to “Drop that gun right now,” but rather “to drop that plate!”  Onlookers were outraged and shouted: “Shame on you!” to the officers.

Arnold has beaten the city before in court, and expects to see them in court soon on their new law making his charitable activities a criminal offense.

Ideally, the Broward County Sheriff would inform the Ft. Lauderdale police that they would be arrested if they attempted to arrest Mr. Arnold.  So far, that has not happened.

In other counties, however, sheriffs have interposed themselves between their people and the threat of rogue power from wayward officials.

America’s history illustrates this on a grand scale. Our War for Independence quickly grew from militia encounters to armed resistance directed and financed (however fecklessly) by the Continental Congress.

In the last century, veterans returning from World War II found that their city of Athens, Tennessee was controlled by a very corrupt machine.  When the August, 1946 Democrat primary election (the only election in town) was literally stolen (the police walked off with the ballot boxes), the armed people of McMinn County rose up and rousted the corrupt regime.  Clean elections then gave a victory to the reform slate.

The Second Amendment was intended to protect the people’s personal arms so they would be able to resist tyranny should an American government ever go off the rails of the Constitution and rule tyrannically.  The Battle of Athens was an applied case of what the Second Amendment is intended to make possible.

In Elkhart County, Indiana, the people have elected a Constitutional Sheriff who has had occasion to interpose himself between the Food and Drug Administration and a county dairy farmer. The FDA was threatening to confiscate the farmer’s dairy equipment because they don’t like raw milk — even though they can point to no problems.  Elkhart Sheriff Brad Rogers threatened to arrest any FDA agents making further visits to the farmer’s property.  End of the FDA threat.

The voters of Elkhart County indicated their strong support for Sheriff Rogers’ interposition.  He was just reelected with 75 percent of the vote.

Rogers’ warning to the FDA has kept the peace in Elkhart County.  Let us hope the time will come soon when Broward County will have a sheriff who understands his role as a keeper of the peace against the Ft. Lauderdale food police.

It’s tough being an anti-gun radical like Michael “Big Gulp” Bloomberg these days.

The former New York City Mayor has pumped millions of dollars into his fanatical effort to get gun control passed.

But that money was no match for the massive grassroots resistance that awaited him.  Even liberal media outlets like National Public Radio were forced to report on the unparalleled strength of GOA’s grassroots:

The result?  Bloomberg lost an epic battle in the U.S. Senate last year — even while media pundits predicted his minions would win.

Within the past year or so, the Bloomberg forces lost ground in several states and failed to pass expanded background checks in many places where GOA was active (like Nevada and New Hampshire).

Having suffered so many defeats, Bloomberg is trying to make an end run around elected legislatures by forcing referendum votes around the country.

And to that effort, “Daddy Warbucks” has pledged $50 million in his crazed effort to remodel this country’s gun laws to resemble England’s.

Turning most gun owners into criminals

Bloomberg’s first attempt at buying a state is in Washington. If he is successful in the Evergreen State, simply owning a gun — without making a tiny mistake which would land you in jail — will be like dancing barefoot in a pit of scorpions.

Bloomberg’s proposal — an initiative which will be voted on in the November election — is 18 pages long.  So the only thing most Washingtonians will know about it is the lies Bloomberg is paying to spew over the airwaves.

Bloomberg’s minions have more than a dozen similar referendums planned around the country for 2015 and 2016.

All of this means that educating and mobilizing the grassroots — and the next generation — becomes even more important.

To that end:

Punk ass Obama Administration Retreats

As you will recall, GOA rallied gun owners several times over the past couple of months in opposition to Operation Choke Point.

Well, faced with a devastating barrage from the Second Amendment community, the Obama administration has staged a hasty retreat on its plan to shut off credit for gun stores through “Operation Choke Point.”

According to an article in The Washington Times, “[g]un retailers are no longer on a hit list deemed ‘high risk’ by the Federal Deposit Insurance Corp. after the banking regulator formally withdrew [this list]” last week.

The FDIC said its efforts to destroy the gun industry “led to misunderstandings.”

But frankly, the only “misunderstanding” in the actions by the FDIC and Eric Holder’s “Operation Choke Point” involved Obama’s misunderstanding of the withering response to his slimy efforts to destroy the Second amendment “by the back door.”alt

With the support of GOA, appropriations legislation in the House had language which would have eliminated Operation Choke Point entirely.  And Harry Reid was forced to pull the bill and derail the appropriations process after Senator Rand Paul, with our urging, threatened to force endangered Democrats to vote on the issue in that chamber.

As is always the case with Barack Obama, one can never assume that he has backed away from his efforts to destroy the Second Amendment.

But last week’s actions are pretty good news for the gun community.  So thanks again for all your hard work!

GOA issues official rebuke to President Obama

As Congress leaves for its August recess, Gun Owners of America is turning up the heat on the White House.

GOA today posted an Open Letter to President Barack H. Obama and pressed him to revise the official White House explanation of the Second Amendment.

Thousands of children across the nation use this official site to get help in understanding the Constitution while doing reports for their civics classes.

Given that fact, the Presidential misunderstanding of our God-given rights — and confusing them with mere privileges — is simply atrocious.

GOA educating the masses as to how guns save lives

While the national media has engaged in a virtual blackout of the tremendous news story out of Darby, Pennsylvania, GOA is helping to spread the news from coast to coast.

As we mentioned in our alert last week, a concealed carry holder in at the Mercy Fitzgerald Hospital saved countless lives on July 24 when he used his firearm to stop a killer who was bent on taking down even more innocent lives.

GOA has published several iterations of this story on its Facebook page … has profiled it on the GOA website … is highlighting this self-defense shooting on other sites and talk shows nationwide … and is currently working on publishing a video for students and media types alike.

Senate Democrats Gear up to Push More Gun Control 
— Even after a CCW holder averts a mass shooting in Pennsylvania!

 

“More people are carrying concealed in this country, and yet the gun homicide rate has been dropping precipitously. We are safer today with more guns ‘on the street’ being carried in good people’s hands.” — GOA Communications Director Erich Pratt on WPFL, Florida (July 28, 2014).

There has been incredible news in the 2nd Amendment community over the past several days.

You may have heard that a DC federal judge struck down Washington, DC’s ban on carrying firearms in public on Saturday. Judge Frederick Scullen’s decision referenced the Supreme Court’s decisions in Heller (2008) and McDonald (2010) — arguing that the carry ban violates the U.S. Constitution.

And last week, a concealed carry holder in Darby, Pennsylvania, saved countless lives when he used his firearm to stop a killer who was bent on taking down even more innocent lives.

Police said the armed doctor “saved lives” and prevented a disgruntled patient from walking down the hall and gunning down people “until he ran out of ammunition.”

One would like to think that such good news would serve as an object lesson for our elected leaders.  But not for Harry Reid and his cohorts.

Senate Democrats to Hold More Hearings on Gun Control

Even though the nation just witnessed a perfect example of how guns save lives in Pennsylvania, Senate Democrats are gearing up for another push to restrict 2nd Amendment rights.

It’s an amazing thing, really, especially considering that several D and F-rated Democrats are in tough reelection fights this fall. We are talking about Senators Mark Begich (D-AK), Mark Pryor (D-AR), Mark Udall (D-CO), Mary Landrieu (D-LA), Al Franken (D-MN) and Mark Warner (D-VA).

So, what would you think Senate Democrats on the Judiciary Committee are working on in order to aid their campaigns?

Answer: GUN CONTROL.

And the gun control which is being pushed on these Senators’ behalf is a particularly nasty piece of work.

Fast Track to Gun Control?

Take a deep breath! You’re in for a wild ride.

“‘Immigration reform will add over 8,000,000 anti-gun voters to the voting rolls,’ Gun Owners of America warned its members and supporters in a January 24 alert.” — The Examiner, January 29, 2014

For months, as you know, GOA has been battling against the anti-gun immigration amnesty bill, which would add 8,000,000 anti-gun voters to the voting rolls.

The political left has attacked Gun Owners of America for rallying gun owners to oppose the anti-gun amnesty legislation. One liberal website even (mockingly) characterized our view as saying that “immigrants must suffer because of their supposed political views.”

Of course, that’s not what we’re saying, but then again, we wouldn’t expect anti-gun liberals to understand.

There were even some conservatives who had misgivings. For example, one pro-gun author confessed that he initially “harbored some doubts” about GOA’s position and even argued that immigration overhaul could actually help gun ownership in the U.S.

But after reading our alerts, he admitted that such a rosy scenario was “probably very wishful thinking” on his part, especially considering the 2013 “Pew poll indicating an electoral bonanza for Democrats — and therefore for ‘gun control’ — should illegal aliens gain the right to vote.”

GOA is very thankful for thoughtful journalists like the one above who took the time to really research the issue — and grateful for many gun owners like yourself who have taken action on our alerts.

The result has been an intense outpouring of “political heat” on politicians in Washington (especially Republicans).

A couple of weeks ago, GOA asked you to contact your Republican Congressman, prior to their retreat, to let them know that their grassroots base (that is, gun owners) do not support anything that resembles amnesty. Other groups have joined the chorus as well.

Since then, media reports indicated that the phones rang off the hook on Capitol Hill — especially in Speaker Boehner’s office.

All of this culminated in newspaper headlines around the country reporting, on Friday, that the anti-gun amnesty bill was dead and we had won:

* “Hope dims for immigration bill,” trumpeted USA Today.

* “Boehner Doubts Immigration Bill Will Pass in 2014,” said the New York Times.

* “Immigration Overhaul Stalls,” said the front-page headline of the Wall Street Journal.

For us to have reached this point was an enormous victory for your activism. And GOA is grateful for all you who made calls and helped tie up the phone lines on Capitol Hill opposing this bill.

But the battle is clearly not over, for buried deep in the articles was a more nuanced story. The Journal said that a pro-immigration leader “was told by congressional aides to ‘take a deep breath’ and that ‘the wheels continue to turn.'”

Thus, there is still some degree of danger that Speaker John Boehner could push the anti-gun bill after primary filing season had closed — perhaps in May, June or July.

This would not be the first time that we have seen defeat snatched from the jaws of victory. In fact, you might remember our most recent alert over the weekend which explained how a Senate committee ambushed pro-gun Senator Rand Paul (R-KY) in an attempt to defeat his language repealing the Post Office gun ban.

So one might wonder: Is this battle over anti-gun amnesty just another political ambush, similar to the one gun owners saw play out in the battle to repeal the post office gun ban?

Well, consider the multiple levels of perfidy that are at play.

Fast Track to Gun Control?

Many of the same business interests that support immigration — for short-term “balance sheet” motives — also support a bill to allow Barack Obama to write virtually any multilateral trade treaties he wants — with little or no ability to stop them when we “find out what’s in them.”

The bill is called “fast track.” The way it would work is that Obama could negotiate treaties, and, once they were negotiated, they would have to be considered under the Senate rules … they could not be filibustered … they would be approved by a simple majority … and they would be unamendable.

Obviously, if the Obama treaties contained provisions limiting the import and export of guns, we would not have the votes to do anything about it, if “fast track” were in place.

Why is this relevant?

MSNBC and the New York Times have floated a “deal” to pass the anti-gun immigration bill. Obama would “give” Republicans “fast track” — because many in the GOP business interests support “fast track” and many Democrats oppose it. In exchange, Republicans would “give” Obama immigration amnesty.

Obviously, some Washington-centered business interests would view this as a win-win.

For gun owners, it would be a lose-lose. There would be 8,000,000 new anti-gun voters, and California-style gun control would be inevitable. On the other hand, newly drafted Obama anti-gun treaties, which could resemble the UN Arms Trade Treaty, would be almost impossible to stop.

Think Obama is so honorable that he would not use treaties to ban guns? Does anyone think that?

ACTION: For now, let’s receive our apparent victory graciously — knowing that we’re going to have to be continually vigilant to make sure the amnesty bill doesn’t raise its ugly head again. So urge your Representatives to remain firm in opposing anti-gun amnesty for the rest of this congressional session. Obama Proposes Massive Gun Ban by Regulation Fiat

In a “Friday media dump” designed to conceal its actions by releasing them after the press has left town, the Obama administration last week announced its intention to push two regulations which would massively expand the federal gun bans imposed on Americans.

“SEE A SHRINK; LOSE YOUR GUNS”

The first proposal — from HHS — would effectively say that federal health privacy laws (HIPAA) do not apply to the Second Amendment.

This isn’t the first time Obama has stuck his leering eyeballs into Americans’ medical records and private affairs.  From its Orwellian government database on Americans’ health records to its voracious seizure of Americans’ phone records, the Obama administration can’t trample our personal privacy fast enough.

But HHS Secretary Kathleen Sebelius’ efforts to turn over personal mental health information to the government’s gun ban blacklist (NICS) is particularly loathsome.

Not to be outdone in the Sebelius/Holder “Mutt and Jeff act,” Attorney General Eric Holder — currently being pursued for contempt of Congress — intends to seize guns from persons subject to “outpatient commitments (even without a court order) (and) … someone (deemed by some bureaucrat to be) lacking mental responsibility or deemed insane…”

More than 150,000 law-abiding veterans have already lost their constitutional rights — with no due process whatsoever — because they consulted a VA therapist about a traumatic incident in Iraq, Afghanistan, or the Balkans.

Under these new regulations, tens of millions of police and firemen with Post Traumatic Stress Disorder — or people who, as kids, were diagnosed with Attention Deficit and Hyperactivity Disorder — could lose their constitutional rights without any court order, merely because they sought a benefit under a federal program.

And you want to know the hidden agenda behind DOJ’s “commitment” language?  We have a member in a rabidly anti-gun state.  Many years ago, he was picked up by police and, without the approval of any court, sent to a mental facility overnight for “observation.”  The mental facility found no mental problems and promptly released him.

However, many years later, as a result of that state’s anti-gun crackdown (which Holder is now trying to emulate), his name has been sent to the NICS system.  He has lost his constitutional rights, and it will cost him tens of thousands of dollars (which he does not have) to get them back.

We believe this is unlawful under current law.  But it will probably not be unlawful by the end of Holder’s regulatory proceedings.

What does Sebelius have to say about this?  Well, she is surprisingly flip:  “There is a strong public safety need for this information to be accessible to the NICS, and some states are currently under-reporting or not reporting certain information to the NICS at all.”

And this from the White House:  “…when persons with a mental illness do not receive the treatment they need, the result can be tragedies such as homicide or suicide.”

But herein lies the problem:  When Americans with Post Traumatic Stress Disorder and Attention Deficit Disorder realize that nothing they say to their therapist is really confidential, they’re not going to be seeking treatment for very long.

But there’s an even more fundamental problem:  Last winter, Barack Obama decided that he would devote the first half of 2013 to the destruction of what he and his supporters characterized as “the gun manufacturers’ lobby.”  Tens of millions of Americans let their senators and representatives know that they found Obama’s views and Obama’s legislation to be odious and offensive.  As a result, it was rejected in the Democrat-controlled Senate.

So now, as has happened so many times before, Obama has set himself “above the law.”  What could not be done using constitutional processes is now being slammed through by regulatory fiat.

The Justice Department and HHS regulations will now be submitted for “public comment and review.”  But, as with everything else Holder and Sebelius do, this is little more than a sham.

Rather, our efforts will be to get Congress to defund these unconstitutional efforts.  And we will start by submitting proposed legislation to friendly senators and representatives.

The battle continues, and now moves to the Senate

LEGISLATIVE UPDATE

Someone once said that the only thing anyone ever learns from history is that no one ever learns anything from history.

Straight from bumbling the shut down, the House leadership yesterday, by a voice vote, slammed through a straight ten-year reauthorization of the poorly drafted 1988 plastic gun ban.

Read GOA’s oped on this subject in this morning’s USA Today.

At least, argue House Republicans, this “straight authorization” of a bad law will prohibit New York Democrat Chuck Schumer from using the reauthorization as a vehicle to enact new, more extensive gun control.

Maybe.

But the House leadership has now handed Schumer a legislative vehicle for passing his gun control.  This means he and Harry Reid could choose to take their ban on 3-D printer guns -– which, by the way, would also ban many metal gun manufacturers -– and send it back to the House.

Just hours after the House reauthorized the anti-gun law, Schumer held a press event in support of expanding the plastic gun ban.

If they do this, then Boehner and his leadership team will once again be swimming in a river of pain –- inflicted by a liberal media that finally sees an opportunity for passing its much-desired gun control agenda.

So the first thing we’re doing is to organize a Senate filibuster of any Schumer effort to pass and/or expand the House bill.

Given that the Senate is currently bogged down in a fight over the defense authorization legislation, we may be able to make it very difficult for Schumer to use the House-passed bill as a vehicle for new gun control.

So please stay tuned.  We thank you for all your activism up to this point.  But just realize that this battle is not over yet.

GOA IN THE MEDIA

Meanwhile, GOA Director of Communications Erich Pratt authored the Opposing View this morning in USA Today.

Among other things, Pratt argued that the plastic gun ban is an unconstitutional infringement of our liberties that is not only ineffective, but could eventually be expanded by an anti-gun administration to ban even more guns.

But what about the issue of smuggling guns onto planes?

Pratt says that renewing a ban on plastic firearms will “not stop criminals from making them or stealing them,” any more than Chicago’s gun restrictions have been effective in stopping shootings there.

Not only that, says Pratt, “smuggling guns onto planes will still be against the law, with or without a plastic gun ban.” And airport X-ray machines will still be able to detect them.

Bottom line, says Pratt, Congress solved the problem of terrorists carrying weapons onto planes after 9/11 — not through additional gun bans, but by “allowing pilots to use guns to defend themselves and their passengers.”

NAGR: What the NRA should be! No compromise with your rights, ever!

While there are many Second Amendment support groups the most well known, and reviled by those that suffer from the mental illness hoplophobia really does very little for the day to day supporter of the Bill of Rights. That being the National Rifle Association. Please don’t get me wrong about the NRA. They are possibly the very first safety organization of any type in history, and it is doubtless that the firearm safety programs started by them have saved countless lives, as well as reduced severe injuries all around the world, and have served the vital function of providing a working template for virtually all safety programs.

Feared by many politicians, the NRA has clout. However, when it comes to politics? The NRA is a true failure. They refuse to fight the tough fights. Only getting into those in which the probability of success is high. Indeed, the refusal to actually get involved in the dirty work led to the formation of Gun Owners of America as well as others. We need to cut off Obama’s escape routes

Your grassroots efforts are making a world of difference on Capitol Hill.  But we need to keep the pressure on if we are going to defeat the anti-gun amnesty bill.
We’ve asked you repeatedly to focus your attention on the Senate bill; today, we take a brief look at the House.
But first, here’s a brief update on White House efforts to resurrect gun control.
Biden’s plug goes virtually ignored by media
 
If a tree falls in the forest, does it make a sound?
We’ll never know.  Joe Biden’s Tuesday press conference to renew his push for gun control went almost completely unreported.  The notable exception was an MSNBC report that the NSA scandal made gun control less likely than before.
The liberal media, instead, spent the last couple of days lamenting that “the air had been take out of the push for [the anti-gun immigration bill].”
What will Boehner do on anti-gun amnesty?
While pro-gun House members held an anti-amnesty press conference, your calls and e-mails to “swing” senators lowered the chances that key members of the Senate GOP might go for a do-nothing sell-out “compromise.”
As Senator Ted Cruz told Rush Limbaugh yesterday, “[There] is nothing more powerful than the conservative grassroots when we are engaged and letting our voice be heard.”
All the while, House Speaker John Boehner told reporters, to their horror, that he wouldn’t bring an anti-gun amnesty bill to the floor over the objections of a majority of House Republicans.  According to anti-gun reporter Anne Kornblut of The Washington Post:  “That’s a real tough one.”
And California Congressman Dana Rohrbacher predicted that Boehner would lose his job if he violated that pledge.
So have we won yet?
Boehner was asked by anti-gun reporters whether he might send a conservative immigration bill to a House-Senate conference –- and allow the conference to turn it into an anti-gun monstrosity.  When asked whether he might rely on Democrats to pass an anti-gun conference report, Boehner replied:  “We’ll see when we get there.”
So that’s today’s task:  To make sure Boehner doesn’t use an anti-gun House-Senate conference to circumvent Republicans in the House.
ACTION:  Click here to contact your Representative.  Ask him to insure that no House-passed immigration bill be sent to conference with an anti-gun amnesty bill from the Senate.
