Outlaw federal agency BATFE continues to ignore the law of the land. Here is an update from GOA.

Gun owners across the nation are still rejoicing over the Supreme Court
decision that struck down portions of the DC gun ban as unconstitutional.

But the Heller decision has also signaled the beginning of a new major
assault by the anti-gun left.

Make no mistake, the anti-gun lobby is not going quietly into the night.
They are absolutely rabid over this decision -- and their friends in
Congress are in a strong position to legislate away those gun freedoms which
the Supreme Court has affirmed.

In the meantime, agencies like the federal BATFE (Bureau of Alcohol,
Tobacco, Firearms and Explosives) appear to have no intention, whatsoever,
of stopping their attacks on law-abiding gun owners, gun dealers and
manufacturers.

In GOA's newsletter which recently landed in mailboxes (The Gun Owners,
August 18), we detailed the lengths to which the BATFE is going to trample
the rights of gun owners and dealers.

 From using paid "informants" to provide false testimony, to 
physically
altering firearms to turn them into "machine guns," to 
abusing and harassing
mom and pop gun shops who cannot afford to legally defend themselves, this
agency appears not only to have little or no regards for the rights of
citizens, but is clearly willing even to ignore the rulings of the Supreme
Court.

As you know, Gun Owners is helping to defend David Olofson, a recent victim
of BATFE abuse who has been sentenced to 30 months in the Federal
Correctional Institute at Sandstone, Minnesota for the alleged crime of
knowingly transferring an unregistered machine gun.

GOA submitted an appeal on August 25, 2008, to get him released from prison,

website.

We took on the case when we learned that the so-called "machine 
gun" that
Olofson owned was, in reality, one of thousands of ordinary semi-automatic
rifles made by Olympic Arms. It happened to misfire a few extra rounds when
a friend was using it at a range -- thus drawing the attention of the feds.
However, it only became a machine gun when the BATFE, behind closed doors,
mechanically tampered with the rifle.

Getting guns to malfunction is a favorite technique of the BATFE as it gives
them a great opportunity to rack up convictions on the possession or selling
of "machine guns," which requires a special type of license.

As a result, David Olofson has been robbed of all his freedom, not just his
right to keep and bear arms. He has lost his liberty, his family, and his
life outside of prison.

It is just a turn of fate that it is David Olofson -- not you or any other
semi-auto owner you know -- who is rotting away in prison.

And that's why GOA came to his aide, and we are pleased to report that you
guys have been a tremendous blessing to the Olofson family.

David's wife, Candy, told GOA Executive Director Larry Pratt last week that
contributions from GOA members have been a tremendous help. So much so,
that she does not need to take a second job, thus allowing her to spend time
with her children.

All of this has resulted from the many GOA members who are making monthly
contributions to help pay the Olofson family's mortgage and car payment.
By the way, a lawyer friend who lives near Candy told her that GOA's brief
was superb. One could could hear the encouragement in her voice that
resulted from what the attorney told her.

So, now that we have the Olofson family stabilized, we're asking you to help
us get stabilized. This case is very expensive, and we need your help to
continue pressing ahead for his release from prison.

The costs in taking on this case are huge, although it's a burden we gladly
bear because of the danger that it presents to ALL gun owners -- especially
those who own semi-automatic firearms. If this injustice stands, it will
give the ATF the green light to put millions of additional gun owners in
their cross hairs.

GOA also needs your financial help because we are using this experience to
work with a team of experts to develop written testing standards that could
be imposed on the BATFE by law. Such a law would protect individual gun
owners, manufacturers and dealers alike, and would be the next best thing to
getting rid of The Gang (aka, the BATFE).

My response to a debate

First, I would like to thank Edger from Opposing Views for commenting.I looked over the debate there about guns, and if they make you safer or not. Vetted experts from both sides of this debate had free reign, and the discussion looks lively.

I may, or may not be considered an expert on this subject. My background is one that includes actually using a firearm to defend myself and others. As opposed to so many that talk about having frightened off an assailant with a firearm. I also spent more than twenty years in a major metropolitan area working as a Paramedic. That gave me a front row seat in the gun play scenario. Over the years I learned a few things from that experience. I also developed some pretty strong opinions after seeing things that happened to friends.

  • I never once saw an instance where a person had his or her firearm taken from them and then used against them. This is an urban myth that the hopolophobes continue to toss around that has little if any basis in fact. Think otherwise? Fine, show us the numbers…
  • I have known five women that were raped and had been denied the ability to effectively defend themselves. Read; they were denied the ability to own a firearm.
  • I have known seven women that stopped an attempted sexual assault using a firearm. See the above for comparison.
  • Kids with guns? Just last year a young man saved his mothers life when she was attacked by Pit Bulls that had already killed another woman in the Parker, Colorado area. While anecdotal many minors have saved family members from marauding bears in Canada.
  • Kids harming themselves or others “playing” with guns are the result of poor parenting, period. Teach your kids about firearms and those things will not be happening as often as they do. Which is about five times a year on average.
  • Gang Bangers’ are not kids playing with guns, they are criminals committing criminal acts. Learn to tell the difference.
  • Submitting to an assault is more likely to result in debilitating injury or death than effectively resisting according to the FBI. Don’t believe me? Look it up for yourself. If you refuse to do that then your mind is made up already, and fact or logic will not change that.
  • Shooting someone by mistake, such as a loved one is the result of poor, or no training. I recommend FRONT SIGHT or GUNSITE for the best training available in the world. Lacking that the NRA has low cost programs almost every where. Just remember, you get what you pay for.

I conclude with this statement: Guns save lives. Guns take lives. It is the person behind the weapon that is either good or evil, smart or stupid. A firearm is a tool. Nothing more.

The Anti-Hunting NRA?!

The American Hunters and Shooters Association (AHSA) is once again trying to confuse hunters into believing two bold lies:  that the NRA does not support hunting, and that AHSA and the Sierra Club do.

In a report released on August 21, AHSA makes the ridiculous argument that NRA is anti-hunting because NRA does not support the same candidates that Sierra Club and other environmental groups support. The problem is, these groups rate candidates on their radical environmental record, not on their support for hunting or for gun owners’ rights. In fact, the politicians endorsed by the Sierra Club are a “Who’s Who” of the most anti-gun politicians in American history. Gun-ban advocates like Barack Obama, John Kerry, Charles Schumer, Hillary Clinton, Barbara Boxer, Frank Lautenberg, Jack Reed, and Teddy Kennedy have all been endorsed by the Sierra Club. Since Teddy Kennedy wants to ban almost all ammunition used by hunters in America, it is impossible to see how the Sierra Club is supporting hunters by endorsing him.

Groups like the Sierra Club rate lawmakers on many issues that have nothing to do with hunters or hunting, and do not rate on some issues that do. While the Sierra Club supports massive set-asides of land under wilderness designations, they fail to consider hunter access to these lands. Wilderness designations often create problems for hunters because they do not provide for methods of access needed to actually use the land for hunting, since all improvements–including roads, trails and other changes–are prohibited. Such designations also prohibit programs to provide food and water to wildlife during times of drought. These policies are hardly good for hunters. Neither is Sierra Club support for anti-gun politicians who would end gun shows, ban guns and ammo, and support gun registration and gun licensing.

NRA knows that without our Second Amendment rights, Americans will lose our firearms to radical politicians like Obama. And without the right to own firearms, our hunting tradition will not survive. With this report, AHSA has made one thing perfectly clear: it is willing to sacrifice Second Amendment rights–and in the end, hunting in America–on the altar of its radical anti-gun agenda.

On the other hand, the NRA Political Victory Fund grades candidates first and foremost on their position on the protection of the Second Amendment, but also on their positions in support of issues relating to hunters. These issues include access to hunting lands, proper scientific management of game species, and expanding opportunities for hunters and hunting. NRA is also one of the most effective advocates for issues that truly impact hunters. Over the decades, NRA has worked hard at the federal and state level to protect and enhance our hunting heritage. NRA worked to reform federal law on migratory birdhunting. We have fought to keep federal lands open to hunting, to open more federal lands for hunters, and to protect conservation reserve programs that provide vital habitat for game species. In the states, NRA has worked for passage of youth hunting programs, for no-net-loss bills that ensure the amount of public land available to hunters is not diminished, and for increased hunter access plans like Open Fields and walk-in programs. AHSA has done none of this.

AHSA claims it is promoting “conservation,” but in truth, the groups it is endorsing are radical environmental groups. For these groups, hunting is either not a factor at all, or, at best, something to be endured but not promoted. In fact, these groups oppose hunting if it interferes with their radical agenda, as it did when it came to listing polar bears as endangered and banning the importation of polar bear trophies.

AHSA knows its report is phony, which is why it never lists any of the anti-gun politicians it is attacking NRA for not supporting. But for AHSA to mislead gun owners and hunters is nothing new. AHSA claims to be pro-gun, but in reality, they are not.

AHSA was created with the specific intent to provide political cover for anti-gun politicians by allowing them to claim support from a “sportsmen’s” group. In truth, the anti-gun credentials of AHSA’s leadership is well documented. In 2000, AHSA president Ray Schoenke donated $5,000 to Handgun Control, Inc. (now the Brady Campaign) and the Ray and Holly Schoenke Foundation also made donations to the Brady Campaign. Former AHSA Board member John Rosenthal remains the leader of Stop Handgun Violence, and has recently unveiled a new anti-gun billboard in Massachusetts attacking gun shows with misleading and untrue claims. And one of the leading organizers, and current Executive Director, of AHSA is Bob Ricker, who has been a paid expert witness against gun manufacturers in a number of reckless lawsuits. AHSA is a front group for left-wing zealots who want to fool sportsmen into voting for anti-gun candidates by lying to them about the issues. That is why AHSA has endorsed Barack Obama and his extreme anti-gun views. That is why AHSA is now attacking NRA for failing to endorse men and women who would end most gun ownership in America, including the guns used by hunters. NRA members, and everyone who really cares about our hunting tradition, should be reassured that NRA does not, and will not ever, endorse the vast majority of radical anti-gun zealots regularly supported by the Sierra Club and AHSA.

You may not have been watching the battle that is brewing over concealed
carry in the Hartsfield-Jackson airport in Atlanta, Georgia, but it may end
up affecting you where you live.

Because of what's happening in Atlanta, the Transportation Security Agency
could decide to allow airports across the country to ban firearms in areas
that currently allow for self-defense.

It all began when Georgia passed a new law allowing permit holders to carry
guns onto state parks, into restaurants that serve alcohol, and onto mass
transit (such as the non-surveillance areas in airports).

The Hartsfield-Jackson airport responded by defying the state law and
banning firearms throughout the entire airport, including areas where
drivers pick up passengers.

This has resulted in a court battle, where presently, a federal judge ruled
in favor of the airport's ban. Now, the TSA may step into the fray by
permitting airports across the entire country to ban firearms in those
locations that are outside of the boarding areas.

Federal law prevents passengers from bringing firearms past airport
checkpoints. But in many states, passengers are allowed to bring guns and
knives into areas such as the pick-up points and the main terminal. This is
what could change very soon.

"Any decisions we make that affect (Atlanta) could affect every other
airport in the country," said TSA spokesman Christopher White to 
USA Today
(8/7/08).

What's at stake here is not the ability to take guns past surveillance
points. What's at stake is the right of self-defense outside of these areas
-- especially where drivers are either dropping off or picking up
passengers.

In other words, drivers who have permits are the ones who would be affected
the most because they would now have to leave their guns at home -- thus
contradicting the very reason they got a concealed carry permit in the first
place... the fact that they wanted to carry their guns outside of the house.

ACTION: Please urge President Bush to put the squeeze on the TSA. This
president should certainly understand the bad-politics of imposing a gun ban
right before an election.

Gun owners won an important vote in the U.S. Senate this week, when more
than three dozen senators stood with Republican Sen. Tom Coburn of Oklahoma
in his battle against Majority Leader Harry Reid of Nevada.

Reid fell eight votes short on Monday of stopping Coburn, who has been using
parliamentary maneuvers to keep anti-gun legislation (and pork) from coming
to the Senate floor for votes.

Sen. Coburn has placed a "hold" on more than 80 bills since 
January of last
year -- including the bill which recently extended the National Parks gun
ban to the Washington-Rochambeau trail.

Under the rules, one senator may block the progress of an objectionable bill
by issuing a "hold" -- a maneuver which prevents a bill from 
speedily moving
through the legislative process.

The frustrated dictator of the Senate (a.k.a. Reid) combined 36 of the bills
which have come under Coburn's ire into a big omnibus bill and added all
kinds of pork to entice senators into supporting the measure. Nevertheless,
Reid still fell eight votes short of what was needed to defeat Coburn's
holds.

GOA wants to thank all of you who took the time during the last week to urge
your senators to stand with Coburn!

VETERANS DISARMAMENT UPDATE

In other Senate news, Richard Burr's bill to repeal large parts of the
Veterans Disarmament Act is gaining steam. The Republican senator from
North Carolina introduced the Veterans Protection Act (S. 3167) after
President Bush signed a gun ban into law this year -- a law which, among
other things, disarms military veterans who have been diagnosed with PTSD.
The Burr bill, which now has 18 cosponsors, would protect the rights of
military veterans and make it more difficult for the Veterans Affairs to
deny them their Second Amendment rights.

GOA members should have received their latest newsletter by now. This issue
contains a key update on the Veterans Protection Act in the House
(introduced by Rep. Virgil Goode) and answers frequently asked questions by

Olofson Relief Fund

David Olofson has been subjected to a gross miscarriage of justice.
What happened to Olofson could happen to any American who owns a
semi-automatic firearm.

He was convicted of knowingly transferring an unregistered machine gun
-- a standard semi-auto rifle which fired two three-round bursts and
then jammed. Gun owners call that a malfunction. The federal government
calls it an easy way to get a felony conviction. Olofson was sentenced
to 30 months in federal prison.

David Olofson is an information technology professional with a wife,
three children and a mortgage. Until his conviction, he was also in the
National Guard.

The Olofson Relief Fund has been set up to allow concerned Americans to
help the Olfoson's make their mortgage and (their one) car payments
while Dave is unable to work.

If you decide to contribute to the Olofson Relief Fund, your credit
card will be charged monthly for the amount you have indicated. This
will continue until Olofson is out of prison -- or you notify us to
discontinue the charges.

In open defiance of the Supreme Court's decision striking down the
Washington D.C. gun control law, the City Council passed an
"emergency" law that keeps in place almost all of the law that was
ruled unconstitutional.

For example, though the Court ruled specifically that the city's ban on
handguns violated the Second Amendment, most handguns still
cannot be registered because D.C. bureaucrats classify
semi-automatic pistols as "machine guns."

Even Dick Heller, who brought the case against Washington's gun
ban, was rejected when he tried to register his handgun because any
"bottom loading" firearm is a "machine gun" 
according to the D.C.
police.

Similarly, while the Court found that "the requirement that any lawful
firearm in the home be disassembled or bound by a "trigger lock" is
unconstitutional, the city kept in place the "lock up your 
safety" law
unless the resident is in immediate danger.

The D.C. Council is thus rendering the Supreme Court victory for gun
rights meaningless, while leaving residents defenseless.

Congress needs to repeal the District's gun control law to ensure that the
Supreme Court decision is not a hollow victory.

According to Article I, Section 8 of the U.S. Constitution, Congress has
the authority and responsibility to govern the District. It can simply
repeal the District's onerous gun law.

Not surprisingly, however, House Speaker Nancy Pelosi (D-CA) has no
intention of allowing the D.C. gun ban repeal legislation to come to the
floor, even though it is cosponsored by more than half of the members
of Congress.

To free the bill from the Speaker's death grip, Representative Mark
Souder (R-IN) has filed a discharge petition to bring the bill directly to
the floor. Rep. Souder needs 218 cosigners for the petition to be
successful. There are currently 109 signers.

There are not many days left in this legislative session, so it is vital that
the discharge petition moves quickly. Please contact your representative
and urge him or her to support the repeal of the D.C. gun ban and to

Dear Representative,

The Washington, D.C. city council is making a mockery of the recent
Supreme Court decision supporting the individual right to keep and
bear arms.

Though the Court ruled the city's handgun ban unconstitutional, DC is
still making it illegal to own most handguns. The Court also ruled that
the District's gun lock and gun storage law violates the Constitution, but
under the city's new "emergency" gun law, firearms must be kept
inoperable unless there is an immediate danger to residents.

Representative Mark Souder has filed a discharge petition to bring a bill
to repeal the District's gun laws to the floor for a vote.

Please stand up for the Second Amendment and sign the Souder
discharge petition.
